This has never happened to me and I hope it never does and it never happens to you either but if a pedestrian or cyclist or motorcyclist is injured in the course of an accident involving a vehicle I am driving am I legally obliged to take them to the nearest hospital and pay for their treatment? This seems to be a common practice where I live but I see it as the source of very serious legal and medical consequences as well as being plain unfair if I feel that I am not at fault.

Under Article 275 of the Revised Penal Code, it is a criminal offense for a person who fails to help or render assistance to another whom he has accidentally wounded or injured. It is punishable by 1 to 6 months imprisonment.

Thanks for the instant reply. One of the things that made me ask is that there was a fatal accident, near to where I live where a van hit a motorcyclist and killed him. I didn't see the accident. By the time I had passed by the poor victim had disappeared but the van was there and was there for some time. This lead me to believe that it had been left as evidence. Is it the case that you should try to help the victim, but not use the car that hit him or her? Also have there been any cases where a well meaning motorist has taken someone to hospital and then been told that by moving the victim his condition had been made much worse? Has any driver been sued in these circumstances or faced charges from the police relating to moving the victim after the accident? Is there any financial ceiling to the motorist's liability when they reach the hospital? On average how do insurance companies react in this circumstance. By taking the victim to the hospital is your policy null and void?

Assuming that you executed all the necessary legal requirements during your extra-judicial settlement, your transfer is effective and legal. The creditors/heirs can sue, but in all likelihood they"ll loose.

Magtatanong lang po ako regarding may case... Since wala pa daw po sa Las Pinas yung small claims cases eh saan kaya ako pwede magfile ng meron ng ganitong services? Medyo malabo kasi sa DTI may naka usap ako dun na 2 years na nyang inaayus yung kaso eh wala parin and its 400+K pa yung amount na pinaglalaban nila, samantalang ako eh 60k lang...

 

Puro letters lang ang pinapadala ng DTI sa respondents at hindi naman sila nasipot sa mga hearing namin... Mediation and Arbitration na wala parin although may verified reply letter sila well as expected babaligtarin nila ang situation...

ask ko na rin po kung ano yung sinasabi na there is no prescriptive period for other heirs to claim share in the property. narinig ka lang kasi sa DZMM nightly legal show .. kasi kung walang prescriptive period then the buyer in good faith will always be open to a claims suit. is this assumption correct?

Noong isang araw kumain kami ng mga tropa ko sa isa sa mga restaurants sa Dampa, sa may Macapagal Ave.

Pangalan ng isang babae yung kinainan namin.

 

Umorder kami ng fresh sea oysters. Noong kumakain na tropa ko, may nakagat siya na matigas dun sa oyster.

 

Yun pala perlas yun! Maliit nga lang at abnormal ang hugis.

 

Eh dahil sa ingay naming magbabarkada, nalaman ng manager na may nakuha kaming perlas. Sabi niya sa restaurant daw yung perlas kasi hindi naman daw namin inorder yun

 

Noong una ayaw naming ibigay kasi naman finders keepers dba. Eh kaso, ipapa-pulis daw kami kapag hindi namin ibinigay. Ibinigay na lang namin yung perlas kasi yung isang tropa ko natatakot magkaroon ng police record.

Thats a lot of crap. Why would they compel somebody to give free legal aid. Doctors and other professions are not required to free aid to their clients. Meron nang PAO dyan.

The SC should have studied this further. 60 hours per year is to unrealistic.

in civil cases, the choice of venue of the case is either the place where the parties are residing or what was stipulated in your agreement if any. in other words, if there are no small claims court (SCC) in these places, then you can not file it in other places with SCC.

 

Also remember that if you already filed a case with the DTI, you can not file a civil case asking the same reliefs because that is considered forum-shopping.

question lang po mga sirs. meron kasi kaming extrajudicial settlement na nanotarize na and publicize kaso may kulang pala na items so sabi saamin magpaaddendum na lang para iadd on yung item na yun. Agreed. Furthermore, I heard that many lawyers attended the IBP National Convention in Bacolod because the IBP will not give lawyers a certificate of good standing unless they attend the national convention. This should be questioned.

When I got my MCLE compliance from IBP Ortigas, I had to get a Postal Money Order from the Post Office at Emerald to pay a one thousand peso penalty. Its seems insulting that the Supreme Court does not trust the MCLE office to collect fees in cash nor trust the lawyers to issue personal checks.

Agreed. Furthermore, I heard that many lawyers attended the IBP National Convention in Bacolod because the IBP will not give lawyers a certificate of good standing unless they attend the national convention. This should be questioned.

 

 

This is a resolution of the IBP National last year that lawyers to be of good standing must attend either the national convention or regional convention starting 2009. The reason behind this was the poor attendance in the Baguio Regional convention. A resolution of the board of governors of the ibp that was not thought of extensively. During last years House of delegates the local chapters already asked that this resolution be revoked. I have inside information that it will be revoked daw. Sana. It is very illogical and stupid.
