Mga sirs, may question po ako.. a friend of mind is legally married to a finnish here and in finland.. they mutually separated nung 2004. question is, since nde pa sila legally separated, pwede ba sila mag file ng divorce?? and since wala sila pinirmahan na pre nup, may makukuha kaya sya sa kanyang husband??

so that your friend can have capacity to remarry again, it should be her husband filing for divorce in Finland. hindi dapat na siya ang magfa-file ng divorce (hindi kasi kinikilala ng Pilipinas ang divorce na na-obtain ng isang Filipino citizen. pero kung foreigner na kasal sa Pilipino ang kumuha ng divorce, OK lang, may bisa yun)

 

2. may makukuha kaya sya sa kanyang husband?

 

depende. one, kung voluntary na bibigyan siya ng Finnish na asawa nya, OK.

two, kung sa batas ng Finland, ang diniborsyong asawa ay entitled sa property o pera from the divorcing spouse, pwede sya makakuha dun sa Finland (but not here in the Phils., since we do not recognize divorce)

depende. one, kung voluntary na bibigyan siya ng Finnish na asawa nya, OK.

two, kung sa batas ng Finland, ang diniborsyong asawa ay entitled sa property o pera from the divorcing spouse, pwede sya makakuha dun sa Finland (but not here in the Phils., since we do not recognize divorce)

 

 

 

 

Thanks sir, pero sa nabasa ko sa law ng Finland e entitled sya.. though it did not stipulate na kung foreigner ang asawa ay may makukuha sya.. uhmm any attorney wants to help?? kaht magbigay sya ng certain percentage to her lawyer kung may makuha sya.. thanks

kung may divorce po sa finland, pwede po, as long as it is the foreigner (husband in this case) that files for divorce in finland. then papa enforce na lang po dito sa Pilipinas yung divorce decree. Kung may makukuha po sya, as roco69 said, depende po sa batas ng finland. sabi mo meron, pero d ka po sure kung applicable sya sa kaibigan mo, depende na po yun sa interpretation ng korte sa finland.

My current franchisor wants me to sign to another contract kasi me bago sila implementation regarding royalty fee..sa nauna ko contract wala naman agreement na i have to pay that amount every month and he's forcing to sign to that contract kasi malaki daw nagastos nila sa advertisement...Can i refuse to sign that contract..Thanks in advance

tapos na ba yung current contract mo? lugi ka dito kapag forced implementation ah. i'm also having a problem with the franchisor though magkaiba naman tayo ng situation. kaya naghihintay ako ng resident lawyer to help me. hehe

Your franchisor cannot force you to sign the new contract since contracts are valid only when entered into voluntarily. It's the franchisor's fault if they lost money simply because they did not think to include advertising costs when computing how much to charge you. Unless there's a contrary provision in the contract, your franchisor cannot unilaterally change the contract whenever it suits them.

The consequence is they will stop supplying me raw materials to my food cart,I know that they would like to implement or add additional agreement in the contract because I earn good in that franchise ...Thats why Im thinking if I would still continue the operation...

Review your franchise contract. If there is no provision allowing the franchisor to stop supplying you materials without cause then they can't do that. If they still refuse to supply you materials, you can cancel the contract and sue them in court for breach of contract and damages. You can even file a complaint against them in DTI (if they're DTI-registered).
