may tanong po ako, sa school po ako nagwo-work, may cooperative po sa amin na halos lahat ng empleyado ay miyembro rin, at dahil sa hirap ng buhay ay napipilitan ang empleyado manghiram sa cooperative para ipang tustos sa pang araw-araw na gastusin, at dahil dyan ay nag ne-negative ang nagre-reflect sa mga payslip ng empleyado, ayon sa aming hr ay bawal daw po ang mag negative ang net-income ng mga empleyado sa payslip at dapat may natitirang 40%, ang gusto nilang gawin ay makipag usap sa banko kung saan dumaan ang aming sahod na sila na bahalang magkaltas ng aming mga utang sa cooperative upang ang magre-reflect sa aming payslip ay dikasama ang kaltas sa utang sa cooperative. ang tanong po ay may batas po ba ukol dito?

Can i ask for additional compensation if ever i get into a car accident.. paying for the repairs or having the other

 

party's insurance cover everything isn't enough.. hassle yung down time ng car mo... what if you don't have any other

 

car to use right? major hassle if it was like that.. what to tell or ask sa party involved in a car accident?

Marriage license is the document which proves you have been authorized or permitted by the government to get married. It is a requisite for getting married; without it, a marriage is generally void. Marriage contract is the document which proves the fact of marriage and is signed during the ceremony.

follow up lang po. for example po nagpakasal kayo sa cityhall. d na nag aapply for marriage license. would that mean that are marriage contract is void?

In general void and walang license dahil sa absence of a formal requisite which is a valid marriage license. Pero may marriages exempt from license requirement, like either or both contracting parties are at the point of death, residence of either party located where there is no means of transport to enable party to appear before local civil registrar, military commander in zone of military operation, marriages among Muslims and between those living as husband and wife for at lease 5 years without any legal impediment to marry.

Kung papayag yung lalaki na apelyido niya ang gagamitin, yung sa lalaki ang gagamitin (ang pruweba na payag siya ay kung pumirma siya sa birth certificate o di kaya may affidavit siyang isusubmit na payag siya) [see R.A. No. 9255]. Kung walang pahintulot mula sa lalaki, apelyido ng ina ang gagamitin

Sabi nga ni moed, in general void ang marriage na walang license dahil sa absence of a formal requisite.

 

pero ang ginagawa kasi ng mga fixer diyan sa city hall, sa araw ng kasal, pinapapirma ka ng application for a marriage license, tapos kanila itong ia-antedate (isusubmit nila ito sa Civil Registrar, kung saan may kausap na sila sa loob na mag-aayos ng mga papeles na ito). in short, palalabasin nila na nag-apply ka for a marriage license mga 10 or more days before the marriage. mahirap namang patunayan na di ka talaga nag-apply ng marriage license kasi nga me mga papel na naka-submit sa Civil Registrar showing na "you applied for a license" bago ka ikinasal. Pag dinenay mo naman ito, ikaw pa ang sasabit sa falsification of public documents kasi nga kasabwat ka sa pagpapalabas na nag-apply ka kahit di naman tutoo.

papipirmahin kayo ng affidavit na nagsasama na kayo ng limang taon bago kayo ikinasal (kaya exempted kayo sa license requirement) kahit di ito tutoo. Again, mahirap idenay ito dahil kung di tutoo na nagsasama kayo for 5 years bago ang inyong kasal, sabit ka na naman for perjury (pagsisinungaling under oath)

May tanong po ako mga LAWYERS, ano ba ang procedure ng annaulment? tama b. Magkano magagastos mga grounds at kung ano ano pa>?

 

 

Actually the proper term is declaration of nullity of marriage since most of the time ang ginagamit naman na ground is Art. 36 which is Psychological incapacity which pre-supposes that your marriage is void since the start. Mga usual fee would range from around 150k-300K depende sa lawyer.

Under Art. 40 of the Family Code: "The absolute nullity of a previous marriage may be involked for purposes of remarriage on the basis solely of a final judgment declaring such previous marriage void". Ibig sabihin, pag gusto magpakasal uli, kailangan madeclare muna previous marriage void ng korte.

Hinde as safe as Torrens Certificate of Title ang tax declaration. Pareho sa Boracay, marami may tax declaration, pero sinabi pa rin ng Department of Environment and Natural Resources na kakadeclare lang nila as alienable and disposable and lupa doon kaya walang right ang may tax declaration sa lupa. Pero ang Boracay naman ay out of the ordinary. Pag matagal na nadeclare alienable and disposable lupa na may tax declaration ka, dapat wala na problema.

mga sir, may iko-konsulta po ako regarding association dues sa subdivision..diba meron mga homeowners association tapos meron monthly dues..

though, ngre-rent lang ako pero nagbibigay ako ng dues...

 

ang tanong ko po kung halimbawa ayaw kong mag-bigay dun sa monthly na hinihingi...may legal something po ba sila na pde ibato sakin..

 

nababadtrip kasi ako eh...tapat ng court yung bahay namin eh nape-perwisyo na ako dahil dis oras na ng gabi eh tuloy parin yung pagpapa laro nila sa court...dinig na dinig samin

yung ingay...kinausap ko na yung presidente ng homeowner regarding this matter but to no avail...

 

kaya naisip ko wag na lang magbayad dun sa homeowners association something nila...

Well, they can file a collection suit against you for your unpaid dues. But that scenario is very nil. Rarely do homeowners associations file cases against their members. It just sends the wrong signal to the other members.

 

what i think they'll do is to make things incovenient for you, i.e., not collect your garbage, not open the gate when you're entering the village, etc.
