Good day po!

 

pls help me, my gf is a newly grad and got her 1st job here in makati, wich lasted for about 2weeks land due to salary prob, 300 lang gusto isahod sa kanya eh college grad sya, we decided to look for another job, she found one after 2weeks ulit at a auditing firm...minimum lang ang sahod, sabi ko sa kanya, simula lang naman yan eh ok na yan important thing is direct sya nag apply.. ngaun po ang tanong ko 8am-6pm ang time nila from mon-fri and sat 8am-12pm, normal working hr is 8am-5pm pero sabi dun, ganun daw tlga sa company nila and ang start pa ng overtime is 630pm, something fishy di ba? andaya....then hindi sila binibigyan ng company ng contract na hired employee sila...sabi ko mahirap yun kasi wala syang habol incase na magkaron ng kalokohan sa kumpanya nya...ano po pwede nyang magawa thanks

kidding aside po.. tanong ko lang po .pwede po bang i PATENT and isang recipe like...YACUN CAKE po.balak ko po kc ako lang yung meron recipe na yun. Would that be posssible?

I don't think there is a prohibition as to patenting recipes. Pero ang tanong ganon ba talaga ka-unique, novel and hindi obvious ang recipe mo, para ma-satisfy yong patentability requirement. Tipong may literature ka na kakaiba ang proseso mo para magawa mo yong yucan cake mo, eh baka pwede i-aprove. Pero kung ang ginawa mo lang is change the ingredients and still used the generic process of making a cake, eh malamang hindi lumusot yon.

Dagdag ko lang, ang computation nong fine is double the face value of the bounced check. And the "double the fine" is for the first offense of the accused, pag in-aver na paulit-ulit ginagawa, the Court is directed to impose the and/or prison term under BP22.

hello po,eto rin po problem ko po sa isang classmate ko. It has been 10 years na po yung utang nya skin 10K po yun. imagine po.lagi ko po na remind sa kanya about her arrears but then dedma nga lang po sya . LAGi nya sabi na wala po syang pera, diba nya naisip na when she got that money , dali nyang nakuha. PAhirapan ko po ang paniningil sa kanya. The only mistake that i made was, i wasn't able to put into writing, kc nga po TIWALA po sa kanya na she would pay that amount in a week (promised nya po), na naging taon na hayzzz... Di naman habang panahon insolvent sya. naiinis na ko. naisip ko tuloy if nilagay ko nalang sa bangko yun,nag interest pa. HELP... ano kaya po habol ko po don? thanks po...

 

Do you have a written proof of the loan? makakatulong yon. Kasi kung wala, you word against your friends word. although pwede naman ma-prove ang loan through witnesses and other people who has direct knowledge of the loan. If you can get your friend to sign a promissory note before even instituting any case against him/her, mas maganda. kahit ngayon lang yong document atleast may proof ka na.

 

There is a new small claims court instituted by the Supreme Court for small claims, claims less than P100,000.00 pwede mo sya i-demanda don. here's a copy of the rules http://sc.judiciary.gov.ph/rulesofcourt/20...2008-8-7-SC.pdf.

 

NOTE, hindi ka pwede i-represent ng abogado, kayo-kayo lang talaga yan.

sir.. pwede kaya po yung mga text messages po namin don ko xa sinisingil.saved ko lahat messages nya. pwede na kaya pong proof yun na may utang sya sakin....and sir.. 10 years na po yun .. di ba meron po yata provison sa law.. (LAWS OF OBLIGATIONS AND CONTRACTS) tama po ba? ang prescription period till 10 yrs lang... meron pa ba nito? if this applies, is there other way po ba.. sayang din kc po 10k yun..kahit mag tumbling k sa daan wala kang mapupulot na 10 k . grrrrr. kakainis nasabi pa namn professional. balasubas naman pala.. grrrrrrrr.....

ah oo nga...hindi ko napansin yong ten years...prescribed na nga. so extinguished na yong obligation. Ok sana yong text. pwede gamiting yon as proof, especially if may reply na acknowledge nya yong utang.

 

Pwede mo gawin is get him/her to execute a promissory note. date mo now, kahit na ba prescribed na, the PN would novate or change the terms of the old loan...kung baga nabuhay ulit yong utang kahit na prescribed. Ofcourse if he/she knows that prescribed na yong obligasyon nya hindi yon mag-eexecute ng PN.

The lawyers here will have a better definition than mine, but the way I remember it, the marriage contract is the marriage vows which you sign at your wedding attested by your witnesses while the marriage license is what you apply for in the municipal/city hall prior to the marriage and is a requirement before you can be joined in matrimony.

I have a different take on this. I think the action has not yet prescribed.

This is because the cause of action has not yet accued. The cause of action only accrues if the debtor, after being demanded to pay his obligation, refuses to do so.

 

Now, what you should do is to send him a demand letter. If he refuses to pay, it is only then that the prescriptive period commences to run.

ok,tnx ,atty. swami... so, first, i still need to send her a demand letter indicating to pay her obligation asap.pag once na ignore nya yun...dun na starts me count ng prescriptive period? ...naku... meron bang additional info now sa provision ng LAWS ON OBLIGATION AND CONTRACT? ano po kayang article yun atty swami..baka tamad na nman keyo read nun... sorry po. super kulit ko po..

 

eto pa pala, pano po yung mga pinahiraman ng late mom (creditor) ko po,pero nandito pa ho yung mga PROMISSORY NOTE nila (DEBTORS), can i oblige them (DEBTORS) to pay their arrears to me or hindi na po pwede since yung creditor (late mom) ko dead na po...so.... yung arrears nila (debtors) extinguish automatically? need your help ,sir...dami din po kc di nakabayad ke mamang ..sayng din po yung pera pag di nasinigil..pls help po.. thank you very much...

Marriage license is the document which proves you have been authorized or permitted by the government to get married. It is a requisite for getting married; without it, a marriage is generally void. Marriage contract is the document which proves the fact of marriage and is signed during the ceremony.

Mga bro, meron naba nagtanong dito regarding sa deed of sale ng handgun, may forsale kasi ako ung personal handgun ko, gusto ng buyer na kunin agad ung gun, after nya magbayad, ano po ba ang legal na paraan dito, parang di yata tama un, paano kung badguy ang makabili at di na ipa renew ang licensed, or gamitin sa crime ung gun nakapangalan pa sakin. Paabroad na kasi ako, kaya benta ko na eh.

 

Sana po may makasagot dito sa thread, pero nag search na din ako dto sa yahoo at google, wala ako makita eh.

1st post ko MTC haha. Sis powerpuff, I think it will depend kasi kung kailan pa nag pass away yung mother mo. Mahirap sabihin kung nagprescribe na e.
