mga tanong ko po hope masagot ng mga de camapanilla natin jan hehehheh.....

 

1. Hello guys, ask ko lang po pano po meron po akong namana from my parents while i am still single. pano if nag asawa na po ako, still EXCLUSIVE PROPERTY ko pa din yun or meron ng kahati yung asawa ko ha? naku, if ever naging conjugal na yun pag nag asawa kami then kahati na sya sa minana ko. hanep naman sya kung ganun, walang kapagod pagod..

 

2. eto pa, our neighbor , na sobrang -ubod ng damot to the max grrrrr..... meron kc silang atis dito tanim nila sa lupa nila. eh ang problem ko po yung mga bunga po nakausli po sa lupa namin. tanong : pwede ko po bang pitasin asap yung mga prutas since na-ungos naman po sa bakuran namin without asking permisssion sa kapitabahay namin? di ba ho consider na pag nanakawa yun?

 

3. eto pa ho ,hihirit pa ho ako, yung classmate ko ho, meron pong problem, wala naman pong trabaho yung ex-husband nya.meron po silang 3 kids.di naman po kayang gastusan po ng classmates ko ang gastusin nila.nabalitaan nya po na may ibang babae na daw yung ex-hubby nya. tanong: pano nya ma-force yung ex-hubby ng sustento sa kanilang mag-iina?

1. The properties you inherited from your parents while you were still single already belong to you. You are already the owner of these properties. Therefore, all your properties will automatically form part of the absolutely community of property, should you subsequently marry.

 

However, if you inherit the properties AFTER you got married, the properties would remain your SEPARATE PROPERTIES, and would not be included in the absolute community.

 

2. I may be wrong on this, but i think the owner of adjoining lot may cut all the branches protruding into his property. There's a particular provision in Civil Code (property) for this. You may just want to check it out.

 

3. Your friend may file a criminal complaint for violence against women (financial violence). That's the innovation introduced by the new law: abandoned wives may file a criminal complaint against their philandering husband for support of their children.

may tanong lang po ako tungkol sa transfer ownership ng kotse gusto ko po sana ibenta yung sasakyan ko pero nakapangalan kasi sa tatay ko.

Kaso nga lang patay na kasi yung tatay ko, ano po ba ang mga requirements na kailangan para malipat sa pangalan ko yung sasakyan at kung gaano katagal ang aabutin.

There is a particular provision in the Civil for that. Sorry, but i don't have the patience anymore to look for that particular provision in my very thick codal book, lest i fall asleep :sleepysmiley03: (reading back my law books bore me!) You may the law students. They are usually very eager to cite the specific provisions (hahaha :thumbsupsmiley: )

dude, i'm afraid that you will have to execute an Extra judicial settlement of the esate before the car's registration may be legally transferred to you. It's kinda tedious because there will be publication requirements, taxes, etc.

 

But, of course, there's the "easier" but "illegal" way to circumvent the cumbersome process. I'd rather not post it publicly. hehe. Baka ma disbar ako.

1. Ano po ang dapat ikaso sa isang opisyal ng LTO sa probinsya namin na hanggang 10pm gamit pa sa di pang opisyal gamit ang sasakyang panggobyerno. Nagkataon po kc nung gabing yun nabangga ng driver (governtment official) nya,lasing nung gabing yun, yung kotse ng younger brother ko. I know na government car yun po ay RED PLATE. San ho kaya pwede mag ask ng damages sa kotse at medical expenses na nagastos namin sa pagagamot? When this LTO official knew what happened ,hayun po kinabukasan punta po sa house namin at hayun wag nalang daw ipapaalam kahit kanino. NApagtanto ko po nun na dapat ang ginawa namin ay dapat kinabukasan ng nangyari yung insidente na yun ,dapt pumunta kami sa GSIS para makakuha ng damages for expenses incurred ( I don't know if this applicable) kc kotse ng government yun within 10 to 15 days yata (correct me if i am wrong here), beyond those days i mentioned, di daw namin na avail, wala na daw kami makukuha. How true is this?

 

2. How can our family oblige our neighbor to clean their vacant lot? It has been 5years that they haven't clean it. Mukhang gubat na po kc yung vacant lot nila, as in.. ang kinakatakot po ng family ko baka po meron na pong mga ahas na natutulog don...naku po...

 

3. May nabili po yung father ko na lupa sa karatig probinsya namin. Mga 10 years na pong di nadadalaw ni papang yun. Pero yearly po ang bayad ng amelyar dun sa lupa. Ang tanong ko po.. pano po kung meron na pong squatters na nakatira don, mapapaalis po ba namin aru-aruda? Mapapaalis po ba namin sila na wala kaming babayaran sa kanila? pls help po... SALAMAT PO

May nakukulong? absolutely, wala. Civil case lang naman yan, so walang nakukulong jan.

dude, you can always rescind/cancel the contract, if there's breach on their part.

i suppose their service being "suck" constitutes breach of contract on their part, which gives you a ground

to cancel/rescind the contract.

 

But dude, inform them in writing that you no longer wish to avail of their services because their service sucks.

that way, you have a defense, in the remote possibility they file a case against you.

1. Here are the remedies: file administrative and criminal cases against the LTO official with the Office of the Ombudsman. The usage of the govt vehicle outside official function may constitute malversation of public funds/properties.

You may also file a criminal complaint for reckless imprudence resulting in physical injuries and damage to properties against the driver.

 

as regards your insurance dilemma, i don't think the 15-day period is true. just like any insurance company, GSIS may require you to submit a police report. So, you should do that. Get a police report. BTW, suing the driver may compel the LTO official to settle the case with you.

 

2. Again, there's a specifc provision in the Civil Code for this. The property may constitute a nuisance, for which you may ask the owner to clean up the lot. If he refuses, you may actually sue him to compel him to clean up the lot.

 

3. No, you cannot simply evict the squatters "ura-urada". You will have to file a court action for that. No person may take the law into his own hands.

may tanong po ako about labor issue. yung president at secretary po kasi ng union namin tinanggal sa trabaho mga 2 months ago. di po ba dapat i-file nila sa NLRC ito kasi po NLRC ang may sakop sa mga Illegal Dismissal? kaya lang di po sila nag-file doon kasi "political" daw ang dahilan sa pagkakatanggal sa kanila. ano po ang opinyon ninyo mga sir? salamat and good day!

Just a clarification on the the first question. The Civil Code also provides that if conjugal funds were used to maintain the absolute property, it can get converted into a conjugal property. An example would be if your property (say a house) which you acquired by inheritance before marriage needed to be repaired or you have to pay the real property taxes on the same and you used funds that you earned while you were married, then the property can be considered conjugal as well. :( Sorry.

Meron po bang specific law d2 sa Phils tungkol sa halimbawa yung babae yung nag-seduce dun sa lalaki tapos syempre dapat yung may sala yung babae since siya po yung nang-seduce and then it led to sex. Tapos claim nitong babae Rape daw e sex with consent naman siya di po ba?

How do i go about in obtaning personal details abt this guy, all i have is his cel number and the plate number of his car? can i go to lto to get the info (will they oblige?) or go to smart or globe to get the info i need? Coz im builiding up a case against this guy.

In rape cases, the presumption of the law is that the woman was not the seducer. Unless clear evidence can be shown that the sex was with consent (i.e. video or pictures, acts immediately before and during the act, countenance of the victim after the act, etc.) the court is more likely to believe the woman, regardless of what really happened. So while there was really consent, the trick is that you have to prove that there was consent.

sa bureau of immigration bossing, may alien certificate of registration yan for sure (ACR). but i think you need an authorized representative or a lawyer to perform such query. medyo mahigpit kasi ang BI dahil sa laganap na fixers (though the authorized reps are the legal fixers... hehehe!)

Nope, not necessarily. If you got pregnant out of wedlock, the child's surname may follow your own surname. The child does not have to follow the father's surname. However, if the guy recognizes that the child as his, the child MAY follow the father's surname.

 

In short, di compulsory or automatic na dapat sundin yung surname nung father.

Yes, the crime constitutes qualified theft. You may opt not to course it through with the barangay anymore because qualified theft has a higher penalty, hence, no longer covered by the katarungang pambarangay. you may file your complaint with the prosecutor's office.

 

don't worry about the liablity of the mother. just state all the facts in your complaint and it's up to the prosecutor if he will indict the mother as a principal conspiratory, or merely accomplice.

Ordinarily, the child should carry your surname. However, should the father recognized the child, then the child may use the surname of the father. When the registering the birth of the child before the civil registry, just have the father sign at the back of the Certificate of Live Birth.

mga expert, need your help. mag papautang sana ako ng pera sa friend ko. gusto ko sana igawa ng kasulatan na pwede gamitin sa legal na paraan kapag nde nagka bayaran. bigyan nyo naman ako ng sample. thanks in advance.

 

You can require your friend to issue a postdated check the amount and date of which correspond to the amount and term of the loan. When the term of the loan ends, encash the check. Once the check bounced, sue your friend for violation of bouncing checks. Since what you filed is a criminal case, surely you will recover the amount of the loan; but not the friendship.
