May tanong po ako. kumuha kasi kami ng bahay ng wife ko and nabayaran naman na namin yung PAG IBIG para makapag Loan kami sa bahay, and now naghuhulog po kami sa Equity na sa developer kaso po nawalan ng work ang wife ko dahil nga po sa krisis now at ng umuwi siya sa pinas dinalaw nya po ang developer ng bahay, nanghihingi naman po ng copy ng contract nya sinabi nya po ang 22o na nawalan nga po siya ng work at before po kasi nag bigay na kami ng iba pang mga dokumento nung bago pa lang po kami kumuha ng bahay tapos sabi po ng developer pag hindi daw nkapag bigay ma forfeit daw ang pera namin pero nakakapaghulog naman po ako kada buwan at walang palya :( sa knya po kasi nkapangalan ang bahay, hindi po kami kasal pero nakapangalan ako sa birth certificate ng anak namin

 

Tanong

 

1. Pwede po ba gamitin ang birth certificate ng anak ko as supporting documents na mski walang work ang misis ko eh makakapagbayad po siya dahil may work naman po ako now.

 

2.Maari bang forfeit ng Developer ang pera ko kng nkakapagbayad naman ako kada buwan ng monthly ko?

 

3. Maari ko bang makuha ang perang nahulog ko kung sakaling hindi kami mkpag provide ng job contract ng misis ko

Basta nababayaran nyo ang dapat nyong bayaran nanakasaad sa contrata, hinde mababawi sa inyo ang lupa at bahay dahil natutupad nyo pa ang obligation nyo sa kontrata.

Kung hinde nyo man matupad ang katungkulan nyo sa developer, sa ilalim ng Realty Installment Buyer Protection Act, puede kayong marefund ng kalahati ng nabayad na sa lupa at bahay kung wala pang limang taon ang nabayaran na installments, at kung lampas na ng limang taon, may dagdag pa na 5% ng halaga bawat taon na sobra sa limang taon na nabayaran, pero hinde sosobra sa 90% ng halagang nabayad na. Mahirap lang talaga magpaliwanag sa tagalog, lalo na pag hinde tagalog.

i thought you were asking for the best option. anyway, a demand letter, in order to be persuasive, must be signed by a lawyer. in other words, you would still secure the services of a lawyer. in filing a complaint with the NLRC, you do not have to have a lawyer because you will simply fill out a complaint form.

 

Also during the hearing or preparation of position papers at the NLRC, you can ask the help of thelawyers from PAO which is free, provided you are qualified.

 

 

Ah ok Sir tama ka best option nga po... NLRC nga ang best... pero matagal yun diba? thanks...

This has never happened to me and I hope it never does and it never happens to you either but if a pedestrian or cyclist or motorcyclist is injured in the course of an accident involving a vehicle I am driving am I legally obliged to take them to the nearest hospital and pay for their treatment? This seems to be a common practice where I live but I see it as the source of very serious legal and medical consequences as well as being plain unfair if I feel that I am not at fault.

Under Article 275 of the Revised Penal Code, it is a criminal offense for a person who fails to help or render assistance to another whom he has accidentally wounded or injured. It is punishable by 1 to 6 months imprisonment.

Thanks for the instant reply. One of the things that made me ask is that there was a fatal accident, near to where I live where a van hit a motorcyclist and killed him. I didn't see the accident. By the time I had passed by the poor victim had disappeared but the van was there and was there for some time. This lead me to believe that it had been left as evidence. Is it the case that you should try to help the victim, but not use the car that hit him or her? Also have there been any cases where a well meaning motorist has taken someone to hospital and then been told that by moving the victim his condition had been made much worse? Has any driver been sued in these circumstances or faced charges from the police relating to moving the victim after the accident? Is there any financial ceiling to the motorist's liability when they reach the hospital? On average how do insurance companies react in this circumstance. By taking the victim to the hospital is your policy null and void?

na file na namin ito noong 2005 pa (complete with publication) at more than 2 years na ang lumipas at wala

naman other claims sa mga property. pwede ko na bang ilipat or ibenta ang mga lupa

sa ibang tao?

 

sabi kasi sa aking ng lawyer ay 2 years ang claim period for other heirs and creditors.

pagnabenta ko na ba after the 2 years limit pwede pa bang habulin ng heirs/creditors

sa buyer or sa akin?

article about sa mga real property laws, right of way, land, construction etc at mga penalties?

 

gusto ko kasi pag aralan yung right of way namen

sa bahay, kukunin namen yung property line namen tapos babakuran na namen

Assuming that you executed all the necessary legal requirements during your extra-judicial settlement, your transfer is effective and legal. The creditors/heirs can sue, but in all likelihood they"ll loose.

Good day sirs,

 

Magtatanong lang po ako regarding may case... Since wala pa daw po sa Las Pinas yung small claims cases eh saan kaya ako pwede magfile ng meron ng ganitong services? Medyo malabo kasi sa DTI may naka usap ako dun na 2 years na nyang inaayus yung kaso eh wala parin and its 400+K pa yung amount na pinaglalaban nila, samantalang ako eh 60k lang...

 

Puro letters lang ang pinapadala ng DTI sa respondents at hindi naman sila nasipot sa mga hearing namin... Mediation and Arbitration na wala parin although may verified reply letter sila well as expected babaligtarin nila ang situation...
