bakal357 Posted March 16, 2009 Share Posted March 16, 2009 hi sir im newbie here ask lng ako ng advice pls here my case...seperated (kasal kami sa simbahan) ako from my 1st wife sence 1995..,when i working sa saudi nagluko sya at tuluyang ng sumama sa lalaki nya...may 2 kming anak na sence then ei tuloy tuloy lng sustento ko even some time sa parent ko sila tumitira but now nasa mother nila sila at may anak narin ung ex ko sa kinakasama nya....now narito ako sa UAE sir at may common wife narin ako with 2 kids narin at gusto nay rin sumama sakin dito pr magtrabaho in that case gusto kong ikuha sya ng husband visa (meaning ikakabit sya sa visang gamit ko)..ang problema di kami kasal at isa sa mga supporting doc. ung marriage contract para maikuha ko sya ng husband visa... Now magbabakasyon ako this coming april 6 at plano namin magpakasal sa civil..no ang tanong ko 1. pede ba akong magpakasal sence almost 15 years na akong hiwalay sa 1st wife ko? HINDI... DAHIL KASAL KA PA SA UNA MONG ASAWA... 2. if ever magpakasal ako at malaman ng ex ko them maghabog even una sya gumawa ng kalukuhan..may habol ba sya? OO... DAHIL KASAL KA PA SA KANYA 3. makakasuhan ba ako at ung common wife ko if ever may maghabol life my ex? OO... DAHIL KASAL KA PA NGA SA UNA MONG ASAWA 4. gusto kong ma annul un kasal ko pero di ko kayang magbayad ng lawyer at di rin ako pedeng tumigil jan sa pinas pr tutokan ung ipafile kong annulment...ano bang dapat kong gawin? TULAD NG SINABI NO BONITO, GET A LAWYER!!! 5. may ginawa kami ng ex na kasulatan sa harap ng baranggay captain (w/ his sign) na pirmado namin pareho na wala na kami pakialaman sa isat isa kahit ano gusto namin gawin sa buhay. WHAT A WASTE OF YOUR TIME!!! BAKIT? Malay mo pumayag siyang magbigay ng suporta, tapos agad ang problema mo. Ang problema mo kung umayaw magbigay ng suporta, kakailanganin mong maghain ng kaso laban sa ama, maaring kriminal (child abuse) o civil lamang para humingi ng suporta. pero sa parehong kaso, kakailanganin na patunayan mo na siya ang ama. di naman ito problema kahit wala kang papeles ng pagkikilala mula sa ama dahil may DNA testing na tayo ngayon. The bond was good for 2 years. I saw a better paying job, didn't finish the 2yr bond in my prev company. It's been 2 years and the company didn't bother to contact me about the bond except recently when they told me that my unclaimed back pay and other separation pay will be deducted from the bond. Are training bonds valid? I'm just wondering because it's been 2 years and my old company didn't do anything to make me pay the bond. Thanks. Quote Link to comment

Noong kumakain na tropa ko, may nakagat siya na matigas dun sa oyster. Yun pala perlas yun! Maliit nga lang at abnormal ang hugis. Eh dahil sa ingay naming magbabarkada, nalaman ng manager na may nakuha kaming perlas. Sabi niya sa restaurant daw yung perlas kasi hindi naman daw namin inorder yun Noong una ayaw naming ibigay kasi naman finders keepers dba. Eh kaso, ipapa-pulis daw kami kapag hindi namin ibinigay. Thanks.i think bonds are valid. it has no negative or positive effect that is contrary to law or public policy. beware in signing contracts with bonds. some companies are ruthless in claiming bond payments from resigning employees. just causes may mitigate or even exempt employees from bond payments though. The company is from the BPO sector, unfortunately, they did not even provide proof that performance was really going down the drain. Also during the hearing or preparation of position papers at the NLRC, you can ask the help of thelawyers from PAO which is free, provided you are qualified. Quote Link to comment

GODzilla Posted March 28, 2009 Share Posted March 28, 2009 writ of mandamus i doubt if mandamus would prosper in this case because the action sought to be enforced is doubtful to be considered as a "ministerial duty" which is what a writ of mandamus is for. secondly, i think the courts would immediately dismiss the case for lack of jurisdiction because there exists an employer-employee relationship so this case falls under the exclusive jurisctidion of the NLRC. ...just my two cents... popoymola Posted March 28, 2009 Share Posted March 28, 2009 May tanong po ako. kumuha kasi kami ng bahay ng wife ko and nabayaran naman na namin yung PAG IBIG para makapag Loan kami sa bahay, and now naghuhulog po kami sa Equity na sa developer kaso po nawalan ng work ang wife ko dahil nga po sa krisis now at ng umuwi siya sa pinas dinalaw nya po ang developer ng bahay, nanghihingi naman po ng copy ng contract nya sinabi nya po ang 22o na nawalan nga po siya ng work at before po kasi nag bigay na kami ng iba pang mga dokumento nung bago pa lang po kami kumuha ng bahay tapos sabi po ng developer pag hindi daw nkapag bigay ma forfeit daw ang pera namin pero nakakapaghulog naman po ako kada buwan at walang palya sa knya po kasi nkapangalan ang bahay, hindi po kami kasal pero nakapangalan ako sa birth certificate ng anak namin Tanong 1. Pwede po ba gamitin ang birth certificate ng anak ko as supporting documents na mski walang work ang misis ko eh makakapagbayad po siya dahil may work naman po ako now. 2.Maari bang forfeit ng Developer ang pera ko kng nkakapagbayad naman ako kada buwan ng monthly ko? 3. moed Posted March 29, 2009 Share Posted March 29, 2009 Basta nababayaran nyo ang dapat nyong bayaran nanakasaad sa contrata, hinde mababawi sa inyo ang lupa at bahay dahil natutupad nyo pa ang obligation nyo sa kontrata.Kung hinde nyo man matupad ang katungkulan nyo sa developer, sa ilalim ng Realty Installment Buyer Protection Act, puede kayong marefund ng kalahati ng nabayad na sa lupa at bahay kung wala pang limang taon ang nabayaran na installments, at kung lampas na ng limang taon, may dagdag pa na 5% ng halaga bawat taon na sobra sa limang taon na nabayaran, pero hinde sosobra sa 90% ng halagang nabayad na. Mahirap lang talaga magpaliwanag sa tagalog, lalo na pag hinde tagalog. Quote Link to comment
