mga atty. may tanong lang po ako....ako po eh dating empleyado ng isang call center....nag resign po ako kse kung nde po eh ite-terminate po nila ako....low performance po kse ang dahilan....pero ang sa akin naman po eh....wla naman po akong account o campaign na ida-dial kya bakit ako dapat bigyan ng memo na low performer ako??....sa madaling salita, nag-resign na lang po ako kse wla naman pong patutunguhan ang usapan namin.....ang hiniling ko lang po eh maibigay ang 13th mo. pay ko kse naman magpapasko....tinanggal na ako sa trabaho eh konswelo na lang sa akin dhil 2 yrs mahigit din ako dun....so eto na ang siste....naibigay na ang 13th mo. sa mga naiwan at ang sa amin eh wla pa raw....in-process pa raw ang mga tseke....pero may mga nangyari nitong nakalipas na araw.....kung dati ang bigayan ng memo for low performance eh lingguhan....ngayon eh arawan na....sa madaling salita....sa loob lang ng isang linggo eh pwedeng mawala ang lahat ng tao sa call center na iyon...(nung umalis ako eh nasa 50 na lang yata ang mga agent...this was just last dec. 2)...so ang tanong ko lang po eh....pede ko po ba clang madaliin sa paglalabas ng tseke ko?.....kse ang sabi nila on or before 23rd of dec. pa....naman....isang araw na lang pasko na.....tseke pa ang ibibigay sa akin (kung maibibigay nga)....eh holiday na ang mga susunod na mga araw....so ibig sabihin....sa 2009 ko na maipapalit ang tseke ko......eh kung magsarado cla before mag 23rd ng dec. eh ibig sabihin wla na kong aasahan na pera????......your answer to this matter will be highly appreciated....thanks...

ur predicament is well taken. syemps, pera mo yan. but the thing is, legally u have a recourse, practically, di recommended. ull need legal assistance on that which could entail bigger amounts... so not worth lang.

kung di pa rin sila mag-aattend sa baranggay, dapat ay bigyan ka na ng baranggay ng Certification to File Action dahil [pang-apat na beses na di sila uma-attend.

 

Pag nakuha mo na yung certification to file action, at kung di naman lalampas ng P100,00 ang hinahabol mo, pwede ka nang pumunta sa Municipal/Metropolitan Trial Court. Me bago ngayong sistema (Small Claims Cases) kung saan magfi-fill-up ka lang ng form, tapos walang abugado na humaharap, kayo lang ng nirereklamo mo, mas mabilis at madali, di ka pa magagastusan ng malaki (kung di lalampas ng P100T ang claim mo!). Ihanda mo lang ang mga ebidensya at testigo mo tungkol dun sa reklamo mo.

dahil nagfile ka na sa DTI, hintayin mo na ito. lumalabas kasi na ang may kapangyarihan upang desisyunan ang kaso mo ay ang DTI na dahil doon ka unang naghain ng consumer complaint. baka ma-dismiss lang ang kaso mo sa MTC on the ground of primary jurisdiction (na ang may unang hawak sa kaso ay ang DTI). sayang naman ang panahon at pera mo, pag ganun

kung meron kang testigo na personal na nakakaalam na umutang siya sa yo at nakita nung ibinigay mo yung pera, pwede kang maghabla. pwede na ito sa Small Claims Cases. Hindi dahil walang kasulatan ay wala ka nang habol. Ang oral contract ay maaari mo ring patunayan at maaari kang maka-recover dito.

 

Alalahanin mo nga lang na ito ay matter of evidence. Kung mahina ang ebidensya mo at ito ay i-dedeny ng kabila, yari ka. Charge to experience na lang ang kalalabasan niyan.

 

Subukan mo munang kulit-kulitin, baka naman madala sa hiya. otherwise, ihanda mo ang ebidensya mo.

You can still demand for the payment even though there is no written proof of the debt. Verbal agreements are valid and binding. As always, it boils down to proving the existence of the agreement. Yes, pwede mo sila madaliin. Ayon sa Revised guidelines ng 13th Month Pay Law, 13th month pay may be demanded by the employee upon the cessastion of employer-employee relationship. Kung ang employer mo ay nag-demand sa iyo na i-settle mo muna mga obligasyon mo sa kanila bago ka umalis, ganun din dapat sa part mo, i-demand mo sa kanila yung obligasyon nila sa iyo.

Question lang po......I am filing a bp22 case for an amount of around P300,000.00. Tanong lang mga sirs:

1. Ano ba ang grounds for filing a BP22? Is a bounced check "Closed Account" enough evidence to file a case against this bozo?!

2. What if naka pay to "CASH" yung check na nag bounce can I file BP22?

3. Nabasa ko kasi sa mga ibang Legal Forums and Website that the court can only impose up to P200,000.00 penalty and imprisonment of > 5 days but < 1Year? Ano ba talaga ang penalties na puwede i habla?

4. follow up on question 3, depende ba yan sa judge na hahawak? Someone told me that I can ask that bozo 200% of the amount of the check bounced?

5. as of what a lawyer friend told me, ndi naraw naiimprison ang BP22 case?

2. Yes, BP will still prosper if the check paid to you is payable to cash;

4 and 5. Yes it depends on the discretion of the judge. It also depends on the evidence submitted whether imprisonment or only fine will be meted.

Non-payment of credit cards is only a civil case and you cannot be imprisoned for non-payment of debts. HOWEVER, once a decision is rendered against you in a civil case, your properties, salary and even bank deposits may be levied upon or garnished. Thus, the moral of the story is PAY UP YOUR DEBTS!

They are fully booked as of the moment and so many filed cases are waiting in line also.....is it ok? is it a valid reason? is such case as "fully booked" really happens on DTI? anyways, I also called up PAO in Las Pinas, they didn't accomodate me as well. They said that small claim cases are beyond or not included with their "extension"...again, is it true? ganun ba talaga ang patakaran sa PAO? Yes there is such a thing as "fully booked" in the hearing of cases, be it civil, criminal or administrative ones. If the calendar is already full, it could no longer accommodate cases anymore, hence, "fully booked". Furthermore, January is usually an inventory month and there are no cases scheduled for said month, thus, your hearing on February 9 is probably the earliest they have.

 

Regarding your query about PAO, please be reminded that the services of PAO is not for everyone. it caters only to the poorest of the poor or what is referred to as "indigents". Who are indigents, you ask? well persons and their families who have a gross monthly income of less than P14,000 in cities are considered as an indigent. I have some credit card debts that I havent paid for 4 months now. Talaga po bang walang nakukulong sa utang? Im paying the other 2 banks pero yung iba hindi ko nababayaran kasi nagkaron ako ng financial problem. Paano po ba kapag nag file sila ng case and wala akong pambayad? At paano po kapag wala akong pambayad for a lawyer?
