Accion reivindicatoria is a remedy of the plaintiff to recover the ownership and possession of a land. This remedy can be availed by the owner, not the illegal settlers. If the MTC rendered the judgment, the petition can be filed to the RTC. If the RTC rendered the judgment, the petition can be filed to CA. Petition for relief from judgment is the remedy of the aggrieved party if the judgment becomes final and executory. If the judgment is taken through fraud, accident, mistake or excusable negligence. If you are the owner, panalo ka na sa lower court pa lang kasi illegal settlers nga po sila. Sayo ang favorable judgment. If final na ang judgment, saka lang makaka gamit ng rule 38. Nag-rent kami around July and within the month. Naireport naman kaagad namin sa lessor na may tulo. Ilang beses nang sinubukang ayusin. Four times to be exact. Sealant nang sealant. But yet, may tagas pa rin. Take note, as in malakas talaga yung tagas like makakailang punas at piga ka para mawala yung tubig. Sabi namin after nung isang linggong pag-ulan ng July. Sige, subukan nilang ayusin ulit since they claim that they "needed the sun" to properly address the issue. So is it still possible to get the security deposit if ever we rescind the contract? Kung residential yan puede ka magfile ng civil case na recovery of possession of property.
