I have a niece whose birth certificate has an error in her name: should be Maria dela Cruz instead of Maria Santos. Santos is the mother's maiden surname while dela Cruz is the father's surname. The parents are not married, that's why the mother's surname was used in the birth certificate. However my niece had been using her father's surname Santos in all her school and working documents.

 

What should my niece do to correct the error? She is now 27 years old, single and plans to apply for a passport, so this need to correct the error.

Walang error sa birth certificate niya. Dahil hindi kasal ang magulang, siya ay illegitimate... At ang illegitimate child, ang ginagamit na apelyido ay apelyido ng nanay, kung kaya't tama na Santos ang apelyido niya... NGUNIT, SUBALIT, DATAPWAT...

 

Kung papayag ang tatay na gamitin ng bata ang apelyido niya (dela Cruz), pwede itong gawin. Sa ganitong sitwasyon, kailangang aminin ng ama na siya nga ang ama ng bata. Gagawa yung ama ng Affidavit to Use Surname of the Father (AUSF). Makukuha ang form na ito sa Civil Registrar.

 

Magpunta na sa Civil Registrar kung saan nakarehistro ang bata at kumuha ng form dun. Magtanong na rin dun kung ano pa ang additional requirements (kung meron man)

Follow up question lang po. Pag nakuha na yun AUSF, pwede na po bang gamitin sa pag apply ng passport ang birth certifcate na gamit ang surname Lorenzo at naka attach na ang AUSF as supporting document?

hindi pa. Ang sinusunod kasi ng DFA ay ang birth certificate ng applicant. Kailangang maiayos muna ang birth certificate ng bata. Ibig sabihin, yung AUSF (plus any other requirement that may be asked by the Civil Registrar) isu-submit nyo sa Civil Registrar, tapos hihintayin nyo munang ilabas ng Civil Registrar ang approval sa change ng surname ng bata, tapos, kailangan din ito ma-forward sa NSO, para makuha nyo dun ang amended birth certificate (yung amendment, actually, nakasulat lang sa tabi ng birth certificate, parang marginal note lang siya stating na ito na ngayon ang surname ng bata.

 

Yung amended birth certificate ang gagamitin ninyo sa DFA.

Mga sir pwede makahingi din ng tulong, ang ginagamit kong pangalan si Miguel Allan sa lahat ng mga transactions ko at mga papeles pero ang nakalagay sa Birth Certificate ko is Allan lang and ang spelling ng Allan comes with a single "L" only at wala yung Miguel na ginagamit ko. Ano ba maganda gawin kasi di ako makakuha ng passport natin. Thanks in advance mga sir.
