Pumunta kayo sa City Assessor's Office para ma-verify niyo kung talagang walang mamayari ng lupa. Kung walang may-ari, tanong niyo na rin papaano.

Hi mga masters,
how does claiming of right-of-way just compensation work?
our lot was affected by a DPWH road widening project several years back.
since may pending court case, di ko inasikaso since baka ma affect ung case.
but since it is taking a long time for the court case, i decided to move forward since i heard from dpwh that it will take 6 mos for the first half of the payment be processed. tapos by installments pa pala.

1) ganon ba katagal ang processing?

another option i am thinking is to sell as is, if sold without getting the just compensation from the govt, and selling the whole lot without reducing the affected road widened area.

2) what are the things that may happen and consider?
heard from dpwh kasi that if we sell it daw without claiming the just compensation, di na daw pued ihabol ng buyer ung just compensation since magiging road na daw. 
how come di na pued eh govt has not paid us yet so technically di pa govt-owned ung lots until paid.

3) what is the best option? 
a) sell the entire lot without claiming? di ba ako habulin ng buyer after knowing na bawas pala ung lote? kasi may possibility na as is nya bilhin with a court case na merong illegal possessor even if the court has decided kami ung rightful possessor un buyer na daw magtataboy?
b) claim the just compensation and sell after the titles has been annotated with the reduced area?

hi po, ask ko lang din. if meron pong lote na pina lease ng matagal say, 30-40 years. tapos within that period we the owners decided to stop the lease and pay anu nakalagay for the breaching of contract. pued po ba un? or di pued? i mean can the owner initiate and cancel the contract without any court case?

1. Matagal talaga. Kakulangna ng pondo ng pamhalaan kaya tumatagal. Kaya dapat palaging pina-follow up. Kung ibebenta, mas lalong malaking problema. Guguluhan ka palaging ng buyer pagnalaman na nabawasan na pala ang actual na sukat ng lupa kausa sa nakalagay sa lupa.

2. Tama, dapat bayaran ka ng pamahalaan dahil sa road widening.

3a. Kung kukunin ng buyer na may case at hindi pa nabawasan yung sukat, may posobilidad na hihingi nang malaking discount yung buyer dahil siya magaasikaso ng problema. Lahat ng estinated na gastos niya ibabawas niya sa supposed to be purchase price katulad ng attorney's fee, pamasahe o pang-gasolina, pangkain papunta sa ahensya ng pamahalaan, sweldo niya dahil hindi siya pumasok, atbp.

3b. Yan ang mas maganda para sa akin.

Depende kung nakalagay sa lease contract na may provision for a pre-termination of contract without any legal process. Yung iba naglalagay silang parang compensation katulad ng:

1. 1 or 2 months prior notice para makahanap ng paglilipatan ng nangungupahan

2. Free 1 or 2 months rental/lease habang naghahanap ng palilipatan
