Need your legal advice kung ano ang dapat gawin sa kapitbahay na nakikipader. Madalas kasi may nagpupukpok sa kanila which is rinig na rinig samin dahil nakikipader lang sila.

Sa residence of Camella Homes kami, at matagal na naming problem ito sa aming kapitbahay which is sila pa ang galit pag madalas namin sinisita yung kanilang lugar na kesyo wala pa daw silang budget na magpagawa.

Sana po makahingi po ako ng legal advice kung ano ang dapat naming gawin.

Nagkaroon na ng decision ang DTI Legal affairs... Sabi nila sa akin na magbigay daw ako ng letter ng Motion for execution para maipasa na daw sa sherif yung kasong consumer act of the Philippines...

Ano ba ang dapat ilagay sa letter or format para dito... It's been 2 years na rin kasi and until now eh puro letter lang ang dumating at hindi naman pinapansin ng respondents (delaying tactics)...

Please let me know your help is greatly appreciated.

Since I filed a estafa case last June 2009 to the procecutors office in the municipality of the respondents... Then the letter of subpoena has been ignored by the respondents and a resolution has been submitted by the procecutors...

Ever since that day wala na po akong balita kung ano na nangyari... Does it mean my case has been denied?

Justice delayed is justice denied...

Nagpaayos po ako ng sasakyan, at first they qouted me 25k dun sa dapat ipapaayos ko lang, kaso nung mabuksan nila nagdagdag sila ng another 20k (that makes it a total of 45k) for a certain repair I didn't plan at all. I didn't have a choice since the car was being disassembled already but to go on with the repair and give the price their asking. Nadala rin ako ng mga magagandang salita nila na pulido sila magtrabaho. So tiwala talaga ako, kaya everytime their asking for a downpayment lagi akong nabibigay hanggang sa nakabayad ako ng 30k pero sobrang minimal pa ng natatapos sa kotse, umabot pa kami sa arguements, nagkasamaan ng loob. Pati pagpipintura hindi matapos tapos hanggat hindi ako nagbibigay ng additional downpayment, kaya napilitan ako magbigay ng 5k. After 6mos mula ng dinala ko dun ang aking sasakyan, tinawagan nila ako dahil ready for pickup na daw. Pinuntahan ko kaagad kaso ang dami pang hindi nakakabit sa kotse, very dissapponting talaga. The paint is such a mess, hindi pantay pantay mga body panels, marami sa scope of job nila ang hindi nagawa. Ayoko na sana bayaran yung natitirang balance na 10k but they forced me or they will not release the car, so I paid 5k and we agreed.

Since the car is not in a very good condition I had to ask another shop to tow it and bring to their shop and also to examine the repair done by the previous shop and to my surprise, napaka daming sira ng sasakyan na dapat ko pang ipagawa para lang magamit at mapaandar.

I filed a case already to DTI. There were summons for mediation and arbitration but none of those were attended by them and until now Im still waiting for their decision.

Got impatient with the DTI, I filed a estafa case to the procecutors office in the municipality of the shop. I was informed na admin case daw yung sa DTI at criminal case yung sa procecutors office.

My question is

1. May laban po kaya ako sa estafa case?

2. What are the possible juriditial remedies? What should I expect?

3. Gaano katagal inaabot ang estafa case?

4. Sa first hearing ng fiscal's office eh hindi parin talaga sila napunta, kaya ba nila paikutin ang situation kung may kilala sila kahit hindi sila napunta?

Puro letters lang ang pinapadala ng DTI sa respondents at hindi naman sila nasipot sa mga hearing namin... Mediation and Arbitration na wala parin although may verified reply letter sila well as expected babaligtarin nila ang situation...

got the latest update from DTI regarding sa case ko. they said that the schedule for my hearing will be on February 2009 pa. They are fully booked as of the moment and so many filed cases are waiting in line also.....is it ok? is it a valid reason? is such case as "fully booked" really happens on DTI? anyways, I also called up PAO in Las Pinas, they didn't accomodate me as well. They said that small claim cases are beyond or not included with their "extension"...again, is it true? ganun ba talaga ang patakaran sa PAO? Pardon me for asking a lot of questions. it's just that I barely know a lot of legal procedures. Again, thank you for your answers.

kung di pa rin sila mag-aattend sa baranggay, dapat ay bigyan ka na ng baranggay ng Certification to File Action dahil [pang-apat na beses na di sila uma-attend.

 

Pag nakuha mo na yung certification to file action, at kung di naman lalampas ng P100,00 ang hinahabol mo, pwede ka nang pumunta sa Municipal/Metropolitan Trial Court. Me bago ngayong sistema (Small Claims Cases) kung saan magfi-fill-up ka lang ng form, tapos walang abugado na humaharap, kayo lang ng nirereklamo mo, mas mabilis at madali, di ka pa magagastusan ng malaki (kung di lalampas ng P100T ang claim mo!). Ihanda mo lang ang mga ebidensya at testigo mo tungkol dun sa reklamo mo.

Hi there! I'm here again to ask for my next step regarding my case. I already got a baranggay clearance and DTI told me to wait for the "hearing". The complaint I have submitted them is still under assesment as of now, according to them and that they will inform me when the hearing schedule will be. As I've learned from you that once I get the baranggay clearance, I can go to the Municipal Hall already. My question is... how about the DTI? shoould I wait for their schedule or proceed already to the Municipal Hall. If I were to do the latter, would there will be any conflict? Would the DTI or Municipal Hall reject my case once they know that I'm working two ways here?

I would just want to seek advice regarding my case. I filed a complaint to DTI-NCR and to the Baranggay Hall regarding a certain car repair shop who has done a terrible back job on my car. And since it's a back job, they would normally ask me to bring my car back to their shop. But for a lot of reasons, I already lost my trust on them. All I want now is for them to give back the money I paid thus, demanding for a full refund.The thing is, the Baranggay Hearing has been settled for three times already and yet none of those was being attended by them. I already informed the Baranggay that I want to settle this case to the Munucipal Hall already but they said that we should have at least one hearing for I could refer the case to the Municipal Hall. But what if, they don't have any plans of appearing, should I just keep on waiting? What would be next important step should I take right now?As to the DTI-NCR, I sent them the complaint through email. And told me to follow up after a week. It's been almost three weeks of following up and I guess getting through our Government Agencies is not that easy. Is there any other way I could do aside from paying a private lawyer or filing a civil case against the shop which I know would just take a decade? Thank you very much. ilapit mo ito sa DTI dahil sakop ito ng Consumer Act of the Philippines. Sila ang magaasikaso ng kaso mo. May i-a-assign sa inyong arbitrator na mag-mediate sa inyo nung may-ari ng shop. Kung hindi kayo magkakasundo, sisimulan ng arbitrator ang imbestigasyon at pag-decide ng kaso. Kung mapatunayang nagkamali ang may-ari ng shop, maaring syang magmulta o maibalik yung perang binayad mo depende sa desisyon ng arbitrator. Dapat hindi mo muna ipagalaw yung sasakyan mo para makita ng arbitrator yung depekto ng trabaho ng nasabing shop.

Thanks for the advice bro... So far andun parin sa pinag trasferan ko yung oto... Nakapag file narin ako sa baranggay... Since matagal umaction eh nag send narin ako ng letter of complaint sa website ng DTi... I just hope may mangyari talaga...

Here's the scenario:

I met this person and we became acquainted with each other. He has a shop. And since I thought that we're friends already, I decided to have their shop(he has a partner in this shop which I only got to know upon bringing my car there last MAY)repaired my car. They qouted me 25K for the Body Repair and Paint. But then, when the car was being checked, they found out a lot of rust inside and a lot of body works daw should be done. They asked me for an additional payment, totalling to 45K all in. At that time, I actually don't have a budget of 45K for my car but since "napasubo" na, I thought I can't do anything about it kasi nga nabuksan na yung oto. Kaya pina-GO ko na rin. So they started to work on my car. I trusted the person I knew, that my car was in good hands. Until after a few months, It was shocking for me to know that my car was being transferred to the latero's (tinsmith) house without me knowing it first. They only informed me when I was asking for the development of the car. And since they got my full trust, I didn't make an isssue out of it..pinalagpas ko na lang . And as weeks passed by, i notice a very minimal improvement on my car. I asked the latero kung bakit ganon. Sa tono nya, parang naiinis din sya sa shop owner..kesyo hindi raw nabibili yung materials,kesyo hindi raw sila masyadong nagkakausap...which I can't believe because at that time I already paid 25K, that was September this year... So from there, syempre nagduda na ko but then I gave them another chance. Ithought it's too early pa to judge them. I waited for the results and of course expecting for the good one until I get tired from waiting. I told them that I'm gona pull out the car already but then again they have convinced me to let them finish the job first .I said yes again and they asked for another 10K for the paint expenses dahil pipintahan na daw after ng laterya. I gave 5K despite of the doubt that why should i keep on paying if it's not yet done already? Should it be 50% down payment upon bringing the car and the other 50% when the work is completety done?

And in between those events, a lot of issues were coming out,a lot of people are getting involved...I also had this issue posted in another forum and naturally the shop owners reacted,that I shouldn't have done that, that they are going to finish naman daw my car ,that even it's taking that long, they can assure me daw that their work is "maayos" at hindi daw tapal tapal lang. But after the issues and the arguments, we finally apologized to each other and continued for the car repair. Although I know na may samaan na ng loob since " I dragged their names daw to shame", I just held on to what they were claiming that they can do it better than the other shops.They even offered me that in case I will not be satisfied, i can bring my car there again.But honestly, I completely lost my trust to them and I swore that I will not gonna bring my car there again.I'm just waiting for them to finish the work.

By the time the paint was finished already i pulled out the car . I told them not to bother putting back some of the interior parts since i'll bring it to the other shop naman. We agreed to pay a total of 40K na lang.I brought it to another shop.They checked the car.And to our surprise..... sobrang backjob tlaga at may mga sira pa and it seems na may mga nakaligtaan pang gawin na included sa scope of job that they presented me.To think that it stayed there for 6 months. Isn't too long for a body repair and paint? I informed them about this but they're still claiming that they did a good job (maayus daw ang pagkakagawa nila), somebody from their side even accused me of ruining the name of the shop! I told them to at least take a personal look at my car. They can visit it anytime to the shop where I transferred it.But they don't have time daw. Pag-usapan na lang daw namin kung anuman yung problema or ibalik ko sa kanila,gagawin daw nila ulit... Ngayun pa??? I told them, they should see the car, all the people behind this project...from the latero, the shop owners..they all should see it personally because I have a lot of questions I want to ask about what happened and what they did to the car.The wife of the part owner, which I'm not sure if involved in the project or with their shop or just a wife,even called me and yelled at me at the phone.Although at the end of the conversation, she said they will try to visit the car last thursday... but until now, no one from them is coming to see the car,so am still waiting for their actions...

I posted this not to humiliate the shop owner or anything. After all, this will not happen if they just did their job truthfully from the very start pa lang.

In this kind situation, if you were in my shoes..what are you gonna do? Would it be just right to ask for a refund?

Nagpabody repair and paint ako ng oto then after 6 months of unsatisfactory of work i decided to pullout the car and transfer it sa isang shop para macorrect and maayus yung repair and paint... Nagkaroon kami ng hand written agreement na both parties agreed to pullout the car for body works and paint total damage is 40k...

Question anong habol ko when it comes to legallity? Kasi to our surprise sobrang backjob ng oto considering na 40k na yung bayad ko... Sabi ko sa owner na tignan yung oto ko at isama nya yung gumawa para makita nila both... Your suggestion is greatly appreciated... Thank you...
