    Do you know the FMV?

    FMV x assessment level = assessed value.

    Where :

    The current assessment levels for land are:

     

    20% - residential

    50% - commercial

     

    ( please do correct me if I'm wrong on the said given)

     

    and after you get the assessed value.......

     

    assessed value x tax rate = amount of tax

    In the province this rate does not exceed 1% and in Metro Manila and other cities, the rate does not exceed 2%.

    - now this is ONLY for land. Di pa po kasama kung may nakatayong bahay / building / etc. or if there were any improvements.

Mga sir, patulong naman ho,paano ho ba ang computation ng Lot and Building Taxes (amilyar) there this assessor from Quezon City hall who contacted us and claim that i need to 60K annual tax for my 200 m2 lot and building (based on her computation), however she claims that she can lower it to more than 1/2 of the total cost provided that kanya is 20K. knowing how does it was computed will provide me with a right tools in dealing with this kind of corrupt goverment employee... help would really be appreciated...thanks

    Tanong lang po, yung lote na bibilhin ko eh may "SECTION 7 RA 26" in the process ng bank loan ko, napa transfer ko na sa pangalan ko ang titulo, ang problema, sabi ng banko, kailangan daw nila ng petition for cancellation na na-filed sa korte ng tungkol sa Section 7 RA-26.

     

    Pa-enlighten naman po, kung ano ito.

  5. my mistake, maybe i should have re-phrase my question..

     

    Magtatanong ho ulit...

     

    a certain piece of property (333 m2) with improvements in QC is up for sale, the TCT is under the name of the seller, a agreement was made between the seller and the buyer to do the following;

     

    1. to subdivide the property into 2 (meaning 2 TCT ang lalabas)

     

    200 m2 will be sold to the buyer (this where the old house is located)

    133 m2 will be retained by the seller

     

    2. after lumabas yung 2 TCT, tsaka pa lang i pa process yung transfer ng 200 m2 sa pangalan ng buyer.

     

    My question is;

     

    a. When the TCT is sent to BIR/RD to be subdivided. Is it posible to transfer the 200 m2 directly to the buyer?

    Initial information that was obtained says that the seller have to applied for subdivision of lot and the title of 2 lot

    (200 and 133) will be under his name. tsaka pa lang pwedeng i transfer yung 200 m2 sa buyer (tama ho ba?).

     

    b. Is direct transfer is posible during the course of sub-dividing the lot, ano po ang procedure, (deed of sale, cgt, lot plan,

    etc) tsaka gaano ho kaya katagal aabutin ang processing?

    The buyer dont have the luxury of time in waiting for the lot to be subdivided into 2 TCT under seller's name, and then

    process it again para ma transfer sa pangalan ng buyer yung 200 m2

  7. can i avoid paying CGT in batangas lot?

     

    gawin mo yung ginawa nung buyer sa 2nd Scenario mo, sabihin mo sa buyer nung Batangas lot na ang bayad sa yong 1.5M ay net. sagot niya ang ibang gastos tulad ng CGT.

     

    Thanks for the reply sir, but i think i cannot do that kasi i already sent out an initial info na ako ang bahala sa transfer into his name....

     

    ang problema ngayon, nauna kong bilhin yung sa QC, while itong sa batangas negotiation stage pa lang, can i still avoid paying CGT here? on a premise na naka loan nga yung QC lot na binili ko, although nauna akong bumili ng lupa in qc before mabenta yung lot ko sa qc?

    FIRST SCENARIO

     

    i have a property in Batangas 200m2 and it is up for sale, sa ngayon nasa inquiry stage palang kami ng prospective buyer.

     

    my deal was 1.5m all in, he give me 1.5m, i give him TCT

     

     

    2ND SCENARIO

     

    I buy a lot in QC, 300 m2, seller opted to have the purchase price of the lot and yung tax, and other fees, is my account (baka next mont ang signing ng DEED of SALE) so next month pa ang payment on tax, etc..Seller will divide his proceeds among his brother and sister, he will also buy a property on a later date, pero mas lesser ang value kesa sa binenta nya

     

    part ng payment ko for this lot would come from a bank loan

     

    My Question.

     

    1. can i avoid paying CGT in batangas lot and qc lot? pa explain naman kung ano gagawin ko, laki kasi ng CGT eh

     

     

    I am willing to sit down and talk to somebody who can help me on this (with reasonable fee syempre at legal, ayaw ko ng illegal, dream lot ko kasi itong sa QC eh)

    Actually i have other comments pa sana... constructive comments actually, sayang kasi yung place maganda pa naman, tapos highly acessible pa with the opening of SCTEX.

     

    Maganda yung concept nila sa resort, kanya lang daming kulang, especially yung maintenance nila, tapos sa gabi ang dilim ng surroundings nila, (ang hirap talaga ng engineer daning nakikita hehehehe)...

     

    anyway, given the chance, i can make some suggestion to Mr. Lee, nakapanghihinayang yung place...

    Scene 1-- In NAIA Departure Area-- Smoking Lounge -- Sabay Kaming pumasok ng Amerikano, sit and smoke inside, lumapit yung pinoy waiter sabay sabi sa akin " Sir order na kayo, kahit bottled water, nagnenegosyo po kami dito eh.. I said OK... then I said isang coke in cans nga pre, sagot ba naman eh.. 45 pesos ho sir, Nag taas na ako ng boses and said... I serve mo yung coke dito at babayaran kita maski dollar pa. then he serve it and i ask again ano gusto mo peso or dollar? and then he replied peso na lang sir.....

     

    What really irked me is this american who came inside na kasabay ko eh, di man lang sinabihan na omorder hanggang maubos ko ang coke ko.. tapos tinanong ko yung waiter? bakit di mo sinabihang unorder yung kano? ngumisi lang sa akin and waiter....PINOY NGA NAMAN OHH

  12. Been fortunate enough to receive ebooks from a genorous person sa kabilang group, his request is to share his books to many as posible, so kung gusto nyo, PM na lang ng email add...

  13. grande island . . . mabato yung beach nila, concrete boulders ha, hindi yung shell or corals, tapos daming nakasingit na mga basura, di nila nililinis... nakakadiri tuloy maligo, they only have one resto, chinese dishes lang ang specialty.. 40 pesos or 55 ata ang isang softdrinks nila 8 oz ha (so imagine how much ang isang order ng dishes nila)

     

    they have atv at 400 per hr ata, they also have swimming pool, check in time is strictly 2:00 pm.\

     

    if you stay at house no 40 + lakad ka to restaurant, ang dilim pa pag gabi.....

     

    in general we did not enjoy our stay there, we booked for two nights, 6 pm pa lang (ng first nights namin) nag paparefund na kami ng 2nd nights namin, di daw pwede, so we are forced to consumed our bookings
