  1. If the technical description on your title is the same as that from which it was derived, how can you say that it was erroneous? In short, determine which is the correct technical description and compare it with your title. The advice is right that you verify with the LRA. Engaging a Geodetic Engr is also correct in order for him to tell you "this is the technical description of your property". After determining from the LRA what is the correct technical description of your property/ title, the question is to what does the error pertain? Will it make your property move from one location to another or it presents an open polygon? If the remedy is really to correct the technical description on your title to conform to that verified from the LRA, then the only remedy is to file a Petition in the RTC where the land is situated for "correction of technical description". The law requires that any correction or revision in the title to land may only be done by the Register of Deeds upon lawful order of the competent court. I believe banks would still entertain your application upon the condition that you file the proper Petition and update them of the developments of the case.

    Sir I compared the title held by previous owner and the tech desc is exactly same as mine. Last year when I planned to build a house on the said lot, the contractor told me na "hindi nagsasara un lote" so basically an open polygon and he told the points that are incorrect. I had a geodetic engineer to survey the lot to verify the correct tech desc. So from the 6 pts described on the title, 2 were incorrect while the other 4 pts are correct(based dun sa existing mohon sa lot).

    Are you willing to pay the services of a geodetic engineer? If so, engage one and he will be able to "verify" your TCT with the Land Registration Authority (LRA) and the DENR Land Management Service (formerly Bureau of Lands), where all Technical Descriptions are approved and filed.

     

    Thanks sir Masi for the advise. I actually acquired the services of the geodetic engineer to survey the lot only and get the correct desc. I will check with him if he can provide the service you mentioned. Thanks again

  3. Question lang po..

    If un technical description ng title has erroneous points ano po ba process nito para maayos? The title indicates 6 pts but 2 of these points are erroneous. I already verified that it is not typo error as the previous title had the same entries. Meron po ba mas mabilis na way to have this settled? Kasi I plan to loan from the bank for house construction.

  4. Follow up questions lang po about this issue. Meron po bang paraan to get out of it? Like pwede ba i-close un current business registration. Magparegister ng new name sa DTI then mag file na lang ng new business permit? Un sa friend ko kasi meron silang paupahan na apartment tapos may business permit nga pero di nag file sa BIR

     

    Closure if you don't update the filing of the required returns. May penalty din of course. Kung yun katransact mo nireport na bumili or nagbayad sila sa yo pero di mo nireport, pwede ka din makasuhan ng tax evasion.

  5. Am using Samsung Grand and just learned that both SIMs will no work in Japan.

    Only 1 will work in 3G while the other is is GSM mode lang. So that means

    only 1 SIM can be used for roaming while the other wont work.

    Any phone you know that can make both SIMs work in 3G mode?

    Nakapunta na kasi ako sa RD pero un scanned copy lang ng title na hawak ko ang nandun sa computer database nila.

  7. Sir salamat sa reply. I went to the RD but un copy kasi nila na nasa computer is just a scanned copy of the TCT that I have. Saan ko po ba pwede makita un orig title ng lot ko?

     

    Ang sabi ng Section 108 of Presidential Decree No. 1529, otherwise known as the Property Registration Decree:

     

    SEC. 108. No erasure, alteration, or amendment shall be made upon the registration book after the entry of a certificate of title or a memorandum thereon and the attestation of the same by the clerk or any register of deeds, except by order of the proper Court of First Instance.

     

    Sa madaling salita, kung may typographical error sa titulo mo, kailangan mo ng court order para i-ayos ito. Kakailanganin mong magsampa ng kaso sa korte para dito (haaaaaaay, gastos na naman!!!).

     

    Siguraduhin mo muna na may error nga sa titulo. Patingnan mo sa geodetic engineer o architect (o kahit sino na may alam sa surveying) yung "technical description" sa titulo mo para mai-plot nga ito (2nd opinion, kumbaga). Kung talagang di nagsasara, punta ka sa Register of Deeds at tingnan mo yung kopya nila ng titulo mo. I-compare mo ito sa owner's duplicate na hawak mo. Kung magkaiba yung technical description sa Register of Deeds copy at sa Owner's Duplicate Copy, yung error ay nasa copy mo lang (Ipa-check mo rin sa geodetic engineer yung technical description na nasa Register of Deeds copy. Kung nagsasara yung technical description sa Register of Deeds copy, AYUN, may typographical error dun sa kopya mo lang. Pwede mo nang gamitan ng eraser ang kopya mo ng titulo at i-retype yung tamang description DOON SA KOPYA MO. Solb ang problem!

     

    Ang problema, kung pareho ang technical description sa copy mo at copy na nasa Register of Deeds.

     

    Kailangan mo ngayon tingnan yung Torrens Title na pinanggagalingan ng titulo mo (makikita ito sa may babang bahagi ng titulo mo, yung portion na nagsasabi na "This certificate is a transfer from Original/Transfer Certificate of Title No. ________ which is cancelled").

     

    Kumuha ka ng kopya ng titulong yun sa Register of Deeds at i-compare mo yung technical description dun sa technical description sa titulo mo. Kung magkaiba, kung saan nagkaiba, mas malamang sa hindi, yun na yung error. Ipacheck mo rin sa geodetic engineer yung technical description ng pinanggalingan na titulo kung nagsasara na siya. Kung nagsasara yung sa naunang titulo, AYUN, may typographical error sa titulo mo. Kung medyo bago pa lang na nai-issue yung titulo mo (or kahit hindi, baka sakaling makalusot) kausapin mo yung taga-Register of Deeds, kasi kasalanan nila, baka pwede nilang gawan ng paraan at i-erase na lang yung mali sa kopya ng titulo mo na nasa kanila (medyo suntok sa buwan na ito kung luma na yung titulo mo, at mas malamang sa hindi, naka-microfilm na yung titulo, di na pwedeng basta-basta gamitan ng eraser at i-retype yung mali sa kopya nila at sa kopya mo), tapos i-retype mo na rin yung mali sa kopya mo.

     

    Kung pareho pa rin yung technical description sa pinanggalingan na title OR ayaw ng Register of Deeds na baguhin yung typographical error, mapipilitan kang magfile ng kaso sa korte para ipa-correct ang title mo.

     

    Kung pareho ang technical description dun sa pinanggalingan na titulo (i-trace mo lahat ng titulo pabalik hanggang sa pinaka-unang titulo to see kung talagang mali ang description from the very beginning or may typographical error lang somewehere along the way) at mukhang mali talaga ang technical description from the very beginning, mapipilitan kang magpa relocation survey sa lupa mismo (haaay, gastos talaga!) para makita kung ano nga ba talaga yung mali sa description. Kakailanganin mo rin naman ito sa petition for correction na isasampa mo sa korte. Pag nalaman na yung mali, ayun, kumausap ka na ng abugado para sa paghain ng kaso mo.

    lot as described by the title, hindi daw nagsara yun property. sabi nya malamang type error

    Anyway, just to answer your questions,

     

    Aside from the deed of sale between the original owner and your uncle, do you have a receipt or any other document to show that there was an actual sale of the property?

    ANS. The only proof that we have right now that there was actual sale of the property is the deed of sale. Actually, the property was not fully paid yet when the sale was made between the seller at ng uncle ko. So ang nangyari, un uncle ko na lang ang nagtuloy ng monthly payments until it was fully paid. We have the receipt of payments made monthly. The property is fully paid but wala pang clean title.

     

    Since the title is still under the name of GSIS, what is the document that transfers ownership to the seller from whom your uncle bought the property?

    ANS. Di pa na transfer un ownership from GSIS to either the seller or uncle ko. Right now wala pang titulo un property.

     

    Aside from the deed of sale between the original owner and your uncle, do you have a receipt or any other document to show that there was an actual sale of the property?

     

    Since the title is still under the name of GSIS, what is the document that transfers ownership to the seller from whom your uncle bought the property?

  10. Bro..thanks sa reply...i followed the steps you gave but from step 3 di ko na magawa kasi di ko makita un advance tab. Am still using XP at present...

     

    ang masasabi ko lang, pag ganyan nangyayari meron failure sa pc mo.. kaya sya nagrestart after shutdown, meron ba blue screen?

     

    try mo to baka makatulong:

     

    1. right click My Computer.

    2. select properties.

    3. choose advance tab.

    4. choose startup and recovery.

    5. uncheck mo yun automatically restart. then hit OK.

    6. shutdown mo uli kung magrestart pa sya..

  11. Thanks sa reply bro...the deed of sale was notarized but the signature of the seller sa deed of sale is not even close to the signature she made sa contract she made with GSIS. Now the seller is already dead and we have no more contact sa husband and mga anak.

     

    What do you mean may discrepancy? Was the deed of sale notarized?

    so long as buhay yung kapatid ng mamatay yung uncle (bale, namatay si uncle, tapos namatay yung kapatid ni uncle), nagmana na siya sa properties ni uncle.

     

    In other words, ng mamatay si uncle, lahat ng properties niya ay namana ng mga kapatid niya at sila na ang may-ari nito mula sa pagkamatay ni uncle.

    at dahil siya na ang may-ari ng parte niya, ng mamatay naman si kapatid, yung parte niya sa properties ni uncle ay kanya namang isinasalin sa kanyang tagapag-mana.

     

    Yung mga anak (at asawa kung meron) na ni deceased kapatid ang may-ari ng lahat ng iniwan ni kapatid, kasama yung parte niya sa property ni uncle.

    in case un sharing ng properties is still in process then unexpectedly un isa sa mga magkakapatid na may anak ay mamatay, un po bang mga anak ang magiging entitled for the share?

     

    #1 kung nabubuhay pa ang magulang ng uncle mo (lolo at lola mo) mapupunta yung property sa kanila.

     

    Kung wala na ring magulang ang uncle mo, mapupunta ang property sa mga kapatid niya (kung full blood brothers and sisters ito, pare-pareho share nila)

     

    #2 nung mamatay ang uncle mo, at ng malaman ito ng aunt mo na nabigyan ng SPA, wala nang bisa ang SPA.

     

    Wala rin cyang karapatan na ilipat sa pangalan lng nia yung properties dahil hindi lng siya ang nagmana nito (see answer to #1)

  14. mga Sirs hope you can provide some legal advise sa concern ko below...

     

    May property ang uncle ko na binili from a person long time ago(siguro meron ng 15 yrs to). The property is under GSIS and until now di pa nalipat sa name ng uncle ko un property. May discrepancy kasi un signature ng contract owner vs sa deed of sale na in-execute nila. There are a few complications sa issue na to so please bear with me.

     

    1). The original contract owner is already dead. I think the husband and un mga anak are still living but right now we have no way to trace their location anymore.

     

    2). To make the issue more complicated, un uncle ko namatay na without having the said property na malipat sa name niya. So right now the property is still with GSIS and what we have right now is the deed of sale executed only.

     

    Paano po ba dapat ang gawin namin dito para magkaron na ng title un property. Ang plan sana is to sell the property but without a clean title mahirapan po kami gawin ito.

     

    Alam ko po mahabang proseso to kasi both of the proponents ng deed of sale are both deceased already.

    But we have to start from somewhere so any advise you can give me will be greatly appreciated.

    ang uncle(kapatid ng mother ko) namatay recently and he had no family nor dependents.

    he has two major properties.

     

    question #1 : kanino po ba pwede mapunta un said properties? Paano po ang sharing nito? as far as i know wala naman po written will un uncle ko.

     

    question #2 : nag issue ko pa kasi un uncle ko ng SPA to one of his sisters. un SPA po ba e valid pa din even after the death ng uncle ko?

    if answer is yes, does my aunt have the legal right/access to transfer all his properties to my aunt's name(with the SPA)?

    nagpapaupa ako ng pwesto and meron kasi akong isang tenant na gusto ko sanang mapaalis na due to delinquency in paying the rent, excessive heat emanating from the place(bakery kasi un business) at nasira na un place due to their neglect to maintain the place well.

     

    Ano po ba ang dapat na maging step ko para mapaalis ko sila. nagkaron kami ng contract but nag expire na sya last Dec 2011. We have not made a new contract as of this time. Meron bang prescribed sa law stating kung ilang araw,weeks,months ang notice ko for them to vacate the premise?

     

    Hope you can advise me on what steps I need to do so that I will not bypass their rights and at the same time serve my purpose to have them vacate my place.

  17. Mga BRO...patulong naman on how I can setup my router with PLDT DSL. I was using another ISP provider before with the router and wala naman problem pero with PLDT DSL e medyo nahirapan ako.

     

    Here is the situation both for my desktop and laptop :

     

    1. I can access outlook express and send/receive emails.

    2. may access din ako sa Skype.

    3. Ang problem is hindi ako maka access sa internet either by firefox or IE. May error message na lumalabas na forbidden to access this server port 80 message.

     

    Am i missing some settings sa router and/or PC ko?

    Your friends are correct. You have to inform all government agencies that you are not operating through an affidavit of no operation, but since you still want to keep your legal personality alive, you have to still comply with the legal reportorial requirements of these agencies. Although as regarding the SSS and Philhealth I believe that is a one-shot deal.
  19. To the law experts there...hope you can help me on the following :

     

    Our head office is in Japan and we maintain a rep office here in Alabang. Due to the current crisis, we are thinking of closing the office but we still want to maintain the SEC registration of our company here in the Phils. We just need to cut down on expenses so it will be like an LOA sort of. Can you please advise on what are the things I need to do to make this happen? I have talked with some of my friends and some advise I got was I need to go to BIR, SSS,Philhealth and pag ibig to officially inform them that our office will close. They said that even if the office has no operation, I still need to go to BIR to submit the tax forms we normally submit even if we don't need to pay anything.

     

    Hope you can provide me a clearer instruction on what I need to do in this situation....

  20. Am using Windows XP SP2...

     

    1). My PC wud not boot up so when I restarted it there was this window that allows you to choose whether to boot it normally or in safe mode. I chose normal boot up, the windows logo came out but after that the screen went blank.

     

    2). I restarted the PC again and since the windows was abruptly ended, the same window came out asking me to select if I will boot in safe mode. This time I chose safe mode. Boot up was successful but in safe mode.

     

    3). However, when I tried to restart the PC again, this time the windows logo came out but after that the screen went black again.

     

    Question : What could be wrong with my PC? Probably hardware problem but no idea where to look at. Hope someone can help me

  21. A very newbie type of question about the display in my PC. Normally the taskbar display is at the bottom of the display. However, when I tried to drag something, bigla na lang napunta yung taskbar on the right side of the monitor. Just can"t bring it back to the normal display at the bottom of the monitor...

  23. Our company is based in Japan and we have a branch office here in the Philippines. The office here is registered but we need to change the registered company name as the company name of our head office has been changed. I think the first step is to go to SEC to apply for a change in our company name but I have no idea at this moment what are the legal documents i need to bring along. Can someone guide me through this?

     

    Really appreciate if anyone can help.
