  1. A law that will consolidate all the little barangays to have at least 10,000 voters each. This will save us a lot of tax money being wasted in all the nonsensical barangay projects. Cases in point are the two barangays near our place which already had three barangay hall each the last ones built for at least P 1 million budget. Both barangays have less than 300 voters between them. What a waste!

  3. My friend got impregnated by a married guy. The guy refuse to acknowledge he is the father of the child.

    Can my friend force the guy to have a DNA test. If the DNA test is postive, can she ask for support for the child.

    Since my friend is poor, where can she go for legal help

    Yes, but only on order of the court. The DNA paternity test can be one of the causes in an action for support.

     

    You can go to any of the law schools with internship or to the public attorney's office or to FLAG or Mabini or some other NGOs (the women's rights group like Gabriella etc may have a higher interest in your friend's case)

  4. If you're really good and motivated, law school will just be another stepping stone to greater heights. It's not really the training that you will get in the law school (many of the better professors teach in more than one school) but the network of classmates, brods and alumni that can really help after the bar and beyond. UP will be tops in this regard, then Ateneo and San Beda.

    i recall during my work around 1998 that we gave pictures for the BIR ID card.

     

    some got their ID cards about my batchmates.

     

    unfortunately, i didn't receive mine.

    If your employer submitted all the necessary documents to BIR your ID should be available in the BIR Revenue District Office which has jurisdiction over your employer. Please check bir.gov.ph for the address. Be warned however that due to long lapse of time maaring na-archived na yung ID mo and will take time for them to locate it. I suggest you call the BIR office first before proceeding or better yet write a letter or maybe email addressed to the Revenue District Officer. They tend to give more serious attention to written queries since there's a law that they can be administratively charged for negligence should they fail to respond within 15 days from receipt of such query.

    Kapag sole proprietorship business at personal TIN mo iisa. Malamang di pa computerized filing sa district nyo noong huminto ka ng business last 2001 kaya wala kang notice of non filing na natanggap. And if the business was not substantial most likely hindi na hahabulin ng BIR yan especially beyond the 3 year period of prescription.

     

    So you need not worry about lalo na after April 15, 2006 kasi by that time yung period to collect ng BIR expire na rin.

    year 2001, nag-business ako sa manila, den nag-close kme the following year...hindi naman ako nag-file ng closure or anything sa bir re sa TIN/TAXES ko...since then wala naman akong naging work or any business na...paano po ba ang gagawin ko sa TIN # ko? meron kayang mga utang na lalabas dun kse di naman nila alam na nag-close na business ko? hindi naman ako pwedeng kumuha ng bago dba? ano po ba ang maganda kong gawin para lang maayos ko ang TIN ko at makakuha na ko ng card at magamit ko uli in the future...thanks a lot

     

    Questions lang:

     

    1. What's your business form sole proprietorship partnership or corporation? Confusing kasi as in "nag-business ako" tapos "nag-close kme". Parang bugtong na si "Natinik ako, ilan kami?"

     

    2. Is it correct to say that you did not file anything with the BIR or just did not notify BIR about closure?

     

    Yung TIN mo can still be used for other businesses or employment and for most transaction with the government. At kapag may TIN number ka na, dapat ibigay sa yo yung card kung available na. Thir is regardless even if you will be found later to have deficiency taxes.

     

    At kung meron mang utang na lalabas malamang mga non-filing penalties lang yun.

  8. Ginawa kasing employment agency yung gobyerno kaya quantity ang workers rather than quality. Yung sweldo ng isang quality employee sa private sector hinati sa limang poor quality government workers. Kaya nagkaganyan.

     

    Nevertheless, dyan sa BIR kahit maliit ang sweldo ng mga examiners dyan marami pa ring magaling. Bakit kamo, eh yung sweldo nila panuweldo lang nila sa driver at alalay nila pero yung kita nila ibang usapan yon.

  9. Malamang nakikitawa ring yung ibang BIR officials dahil malaki naman ang pakinabang nila sa sistemang ito ng gobyerno.

     

    At ingat lang, tinitingnan na nila ang LTO records of car ownership para malaman kung may sufficient source of income yung mga nakakabili ng kotse. Kaya ng hiningi ng LTO yung TIN mo para ma check kung may undeclared income ka.

     

    Kaya pag nagkataon ikaw pa pagtatawanan ng mga taga gobyerno. Huwag naman sana.

     

    Kung gusto mo irereport mo sa Ombudsman o kaya sa DOF kung discourteous ang government official na ka deal mo.

  10. i have another question BIR gurus. wer planning to close a small business. the past 3 years of the operation of the company was not that goood. its even breakeven or sometimes loss but there are time na may onti kita. so from 3 years ago till now hindi na po nakabayad kc ala naman talagang kita na eh.

     

    pag nag close na ba ang company mag kakalkal pa ba sila ng papers ng compny? do we really have to apply for closure or let it die in a natural way? i meant kung 10years na hindi na mag remit meaning close na talaga?

     

    ano naman ping disadvantage noon?

    We need to make several assumptions to complement the stated facts, para medyo makumpleto. We wil assume that the business was registered with the BIR, operated prior to the 3 bad years with profit, that tax returns were filed previously. Not sure what you exactly mean sa "hindi na po nakabayad" since this could mean filed a return but declared loss thus no payable or just plain no filing of return.

     

    You mentioned of two ways of "closing" the company: 1 natural death (?) pabayaan mo na lang 2 go through the legal process. You ask for the risks of closing, obviously, according to # 1, pag sa #2 kasi, ang final output nuon eh tax clearance meaning approved ng BIR.

     

    So sa #1 after ten years, if you stop filing any return (actually BIR computer will know that immediately) and the BIR discovered, if they can show proof that income was earned during those years you did not file, BIR can still assess you 10 years from discovery or file a criminal case.

     

    Of course, kung ang income ay masyadong maliit, BIR, with its discretion will likely apply the de minimis principle meaning the tax that can be collected is probably less than the cost of collection. Pero this is not a legal defense, BIR can still pursue both criminal and civil cases kahit maliit lang ang tax involved.

  11. zonal valuation na ang gamit nila sa No. 2

     

    Actually, in determining the tax base for capital gains tax liability, BIR will apply the highest among the three below:

     

    1. contract price

    2. fair market value as determined by BIR (zonal value)

    3. fair market value as declared by the land owner (tax declaration value)

     

    The third is the reason why BIR requires the submission of the latest tax declaration. While generally # 3 is the lowest, there are some Metro Manila cities e.g. Makati and Manila which has FMVs higher than zonal valuation.

  12. Upto what extend did the 2000 corporation pursue its registration. Hanggang SEC lang ba, o hanggang City Hall at BIR? Filing of affidavit of non-operation, kasi, is required by SEC, City Hall and BIR. Sa BIR even with such affidavit, kailangan pa rin na mag file ng mga returns.

     

    Paano isara ang isang company? Sa SEC - you have to amend the articles of incorporation shortening the corporate life; sa City Hall and BIR - notice of termination will do but you can expect an assessment or investigation before clearance is issued.
