  1. As per RA 7641, Article 287 of the Labor Code has been amended, to provide for, among other things:

     

    "In the absence of a retirement plan or agreement providing for retirement benefits of employees in the establishment, an employee upon reaching the age of sixty (60) years or more, but not beyond sixty-five (65) years which is hereby declared the compulsory retirement age, who has served at least five (5) years in the said establishment, may retire and shall be entitled to retirement pay equivalent to at least one-half (1/2) month salary for every year of service, a fraction of at least six (6) months being considered as one whole year.

  2. Who is the developer of the condo? When you refused delivery because it was not the agreed upon size, what did the developer say? It would be better to settle this amicably if a compromise could be made, as the determination of this issue could take long.

     

    Sir, I actually requesting for a replacement unit from the developer, however, they offered me available units with the same area of 15 sq.m. last monday i was able to write a letter of complaint address to HLURB and Pag-ibig re my case. I awaiting for their responses.

    tol, advise lang, dahil mo ang mga testigo nyo plus ang ate mo nyo sa abogado o kaya sa Public Attorney Office para mga magawaan ng affidavit... dalhin nyo yon mga resibo ng credit card na ginamit ng bf ng ate mo para maisama sa affidavit ng ate mo...

  4. How about the size of the unit as stated in the contract to sell, is it the size of the unit being delivered to you?

     

    no sir, per contract the area is 18.5 sq.m while per measurement of my engineer friend is more or less 15 sq.m.

  5. mga sirs, can anybody help me, i bought a condo unit, thru pag-ibig, however, the area is much smaller compare to the model that the developer shown to me. the bad thing, that my pag-ibig loan is already taken out by the developer and still i not move in because i did not accept the condo unit. i already filed a complaint with hlurb and pag-ibig. what else the other legal step that i need to take... thanks po...

    bro, dapat napag-ugnayan na kayo sa abogado (kung wala naman kayo pera, puede sa PAO) upang malaman nyo kung anong kaso puedeng isampa at malaman din nyo kung mananalo kayo... sa akin lang eh katarungan para sa sis mo...

  7. mga sir hihingin ko sana ang opinyon nyo.yung ex-bf kasi ng sister ko may utang sa kanya. more or less 130k in cash at sa credit card nya. naclose na yung 2 credit card nya. yung isa binayaran paunti unti ng sis ko(around 30K),yung pangalawa di pa nasesettle. nasa 40k sya pero napababa sa 16k. ang gustong mangyari ng hinayupak na ex-bf ng sis ko, babayaran nya yung 16k pero pipirma ang sis ko sa kasunduan na di na hahabulin ng sis ko yung iba nyang mga utang. or maghati sila sa 16k tapos yung mga sinasabing utang nya daw eh babayaran nya pag ipinabaranggay na sya at saka sya magdedemanda dahil muntik na daw syang saktan dahil nging magulo yung huling pag-uusap nila.pero walang sakitang naganap.although di naman kami natatakot kasi sa pagkakaalam ko wala nmang kasong "attempted physical injury" heheh.ang concern lang namin eh,sa tingin nyo po kung ihahabla namin sa baranggay o sa korte may laban ba kami? meron bang legal kaming magagawa para mapagbayad sya sa mga utang nya?

     

    tol dapat ang ginawa ng sister mo, nagfile ng kaso sa korte, di makatarungan ang gusto ng ex-bf ng sister mo, atleast sa korte may settlement na maayos at dokumentado pa ayon sa batas...

  8. eto ang tanong ko. may ex-gf ako noon. naghiwalay kami nung nabuntis sya. hindi ko alam kung ako ang nakabuntis o ibang lalaki. sinsabi nyang akin, pero hindi daw siya hihingi ng suporta. ayaw nyang ipakita ang bata sa akin. ngayon, gusto kong sumuporta kung anak ko talaga sya. syempre gusto ko rin makita. pero hindi ko pa rin sigurado kung anak ko sya. kasi willing naman ako maging responsible sa bata kung ako nga ang ama (legal obligation ko naman talaga ang suportahan ang bata, hindi po ba?). pero ayaw ipakita ang bata o magpasuporta sa akin ang ex-gf ko. ano ba dapat gawin ko?thanks in advance.

     

    bro, dalawang bagay lang yan, una, kung ayaw nya wag na lang...

     

    pangalawa, kung gusto mo talaga suportahan ng bata, kailangan mo nang pumunta sa korte, kasi sila ang magdedetermina kung anak mo o hindi ang bata at sila din ang magdedesisyon kung magbibigay ka ng suporta sa bata...

  9. Atty's, need enlightenment please re: civil marriage.

     

    My brother has a gf who is 3 mos pregnant and they want to get married soon on a civil rites without her parents consent considering that she is a chinese while he is a pure Filipino. She is also an INC at 23 y/o while he is a Catholic at 32 y/o. Is it true that only a birth certificate from the civil registrar and 2 witnesses are required to have the civil wedding solemnized legally? Can a lawyer (a friend of mine) exercise the civil wedding? How about a mayor? Kindly share your experiences and other requirements that is necessary?

    Based on my experience => at their age, no parent consent is required since they are already at legal age (knows what is right and wrong). Not only birth certificate is required for a civil wedding, the following docs must be accomplished:

    1. the birth certificate must be authenticated (from NSO - East Avenue);

    2. the guy must submit a certification of no marriage (also, from NSO - East Avenue);

    3. the couple must attend seminar on marriage counseling (reproductive health / family planning);

     

    After the docs have been submitted to civil register to the municipal where the residence of girl located, civil register will assign a judge to preform the civil wedding.

     

    Mayor can also preform the civil wedding but I highly recommended Judge will preform the civil wedding. Mostly documentations problem arose if the Mayor preform the civil wedding. Also, the office of the Judge will take care of the process of marriage contract, you have to do is to follow up it at the civil register after 1 week from the date of wedding.

    Mr. B and Mrs B are legally married under the Rep of the Phil...

    If Mrs B was proven to gave birth to an offspring NOT by Mr. B, will this be a prima facie evidence for the crime of ADULTERY ?

     

    What if Mr. B had an offspring to another woman? What will be the case against Mr B?

  11. Is there a "legal" way to lower property tax?

     

    make it involved into religious activities (such as chapel, recollection site) or into charitable activities (like hospicio de san jose)... it means that you have no gain (no income) from your properties.... :thumbsupsmiley:
