  1. A contract, to exist, doesn't need to be in writing.

So long as the parties already agree on the rendition of service or the giving of something by one party to the other, there is already a contract!

Even without a written Contract of Sale, or Deed of Sale, a contract of sale may already be perfected (you don't execute a written contract when you get on a jeep, do you, and yet there exists a Contract of Carriage between you and the jeepney driver, you undertake to pay the fare, the driver undertakes to take you safely to your destination).

And that is the reason why it is hard to say whether he can still back out or not. It's difficult to say whether there is already a complete agreement between the parties without knowing whatever it was they really intended to do.

Understood Atty. Thank you very much.

  2. Nope, when a contract of lease expires, and there is no clause allowing automatic renewal, or renewal at the option of the tenant, the landlord CANNOT BE FORCED TO ENTER INTO A NEW CONTRACT OF LEASE. Whatever his reason, and even without a reason at all.

Thank you Atty. Very clear explanation.

If the contract of sale has been perfected, the seller can no longer back out without becoming liable for damages. he may even be forced to consummate the sale. the question then would be: has the sale been perfected? Unfortunately, without any other fact aside from the deposit of P1M and the signing of an acknowledgment receipt, it is a bit difficult to say whether the sale has been perfected or not, as the circumstances surrounding the transaction, and the understanding between the parties, have to be considered.

There is still no Contract of Sale, Deed of Sale of any sort. Just the acknowledgement receipt.

  3. will internet addiction hold ground in an annulment case. me and my kids were left on our own while she stays online for 18 - 24 hrs a day chatting on the PC. She did that for almost 3 years. threatened to shoot the computer, and she did the unthinkable. she hugged the computer. natawa nalang ako. she has an online boyfriend who is based in the U.S .

  4. 1. do we really have to split the money and the properties down the middle?

the law actually allows the spouses to enter into a different sharing agreement. however, if you can't agree, then I'd say the Court will have to split the properties between the parties equally (if it fits into 50% of the properties, then you get the house and lot where you and the children are living in, since the children are with you)

    2. do I still have to give monthly?

If the annulment is granted, not anymore if the kids are with you.

    Thank you so much sir....

  5. Sir in annulment do we really have to split the money and the properties down the middle? And do I still have to give monthly. The kids will be living with me not with my wife.

  6. magkalayo yang choice mo. TEC9 is a 9mm semi-auto pistol while the S&W is a revolver. Revolver is slow and packs a limited number of ammo. kaya lang simple to operate. a pistol packs more ammo and is relatively faster versus the revolver. Ano ba purpose mo sa baril mo? for home defense, competition or personal carry?

i suggest you handle both guns and see which is more comfortable with you. which one do you think is easier for you to shoot.

pero kung wala ka pang experience sa mga baril. i suggest go to a shooting range and rent a few guns. tingnan mo kung saan ka comfortable.

wag ka basta bibili ng baril. madali lang bumili lalo na kung may funds ka. nakakainis yung bumili ka ng baril tapos wala palang kwenta in the end. wala bibili nyan sa yo agad. mabenta mo man, lugi ka pa.

I will take your advice and go to a range. Would you suggest a good shooting range one where i could rent guns? Thank you sir for your advice....I live in the Q.C Libis area

i'm curious where are you gonna get the TEC-9?

Sir a gun collector is selling his TEC9 but its full auto

  7. Thinking of buying my first gun. Im torn between a .38 S&W revolver and a TEC9 ...

What are the advantages of a revolver over the TEC9 and vise versa...need expert advice..

This is my first time in having a gun. So please bare with my not so intelligent questions..

  8. Sorry for OT

Just a warning...about a month ago I had my PC repaired and cleaned in that building beside PNB.

They changed the CPU Fan and i requested also for them to clean the inside of the CPU. Upon

getting home i noticed my computer really slowing down. To my horror a part was missing.

Instead of 1Gig or RAM it was only 500MB of RAM. The guy who cleaned my computer also took

and changed my RAM....Lesson learned never leave your computer while in service

  9. bro,

my lawyer told me it' around 70K more or less....

you just have to bring your marriage certificate...

maybe you can hire a lawyer who charges less....

    hth sir

Thank you sir....medyo na relieve ako....150 to 250K ang annulment.. no plans of getting married anyway thanks

  10. I got a 15 yr old too, and I noticed that at that age, kids don't care what stuff you got in your pc casing.

    The most important thing is:

The computer needs to play games smoothly, and play it with excellent special effects.

30K is a good budget, but 40k is a more realistic.

thank you sir... so i just list this down and bring it to gilmore?

  11. Ei bro, first and foremost, how much is the maximum budget that you are setting aside for this new pc? Whatever you do, it all boils down to how much you are willing to spend. If you are living in cubao then malapit ka naman na sa gilmore. Duon maraming shops with parts that are usually not available sa mga malls.

Give me an exact figure sa budget mo, then I'll help you out by making a list of the parts(with brands and model numbers) that you should get for your budget.

sir , maybe running to 30K would be good enough..
