  1. Might as well let the vendor work on the update of the tax declaration. Tell your friend to get the copy of the updated tax dec and also have the vendor get a copy of a certified true copy as well for submission to register of deeds upon transfer of the title to your friends name, if he does purchase the property. Come to think of it, if he could, might as well let the vendor submit the real property tax clearance to him as well, to make sure the real property tax payments are current and lessen the acquisition of documents necessary for the transfer of the TCT to his name.

  2. The tax declaration follows the TCT. Before you can have the TCT transferred to another persons name, the Register of Deeds requires a certified true copy of the tax declaration. Necessarily, the tax declaration has to be consistent with the TCT. In this case, if your friend buys the property and he wants the TCT transferred to his name, he will have to update the tax declaration of the property to reflect the circumstances of the new TCT. It will not be difficult to update the tax declaration, though, as the current TCT itself will specify the circumstances of the reconstitution and as you yourself said, the current TCT even bears the previous TCT number. This will be a simple matter for the Assessors Office (department in charge of Tax Decs) to take notice of.

    Basically, my understanding is that the tax declaration must be changed to reflect the reconstituted TCT. once the new tax declaration comes out. that is the time that my friend can proceed with purchase and the transfer. Am i correct? thanks

    I have a question: My friend is going to buy a property in QC. The original TCT was shown and upon verification with the LRA, The original was lost in the fire in QC hall in the 80s. The seller was able to have the TCT reconstituted(via judicial process).The old TCT was surrendered & a new TCT bearing the number 004-RT2011xxxxxx(yyyyyy) (where yyyyyyy is the original TCT number) was issued & was verified at the LRA. But the tax declaration is still the old one (bearing the old details).

     

    My question is: Is there a need to change the tax declaration also after the reconstitution? if my friend bought the property without getting the new (updated) tax declaration, can he have the property registered in his name?

  4. As the esteemed laird and maester of all things Dr_PepPeR has replied, the acceptance of the SPA is up to you, however to answer your questions:

     

    1. Yes, then attach the SPA to the DoAS (Deed of Absolute Sale as opposed to Deed of Sale), with the father signing for each of the children. Make sure that the SPA is notarized to minimize your legal responsibility.

    2. The RD can be fairly strict, again that depends on how much greasing you do.

    3. Any and all of the children can contest it and tie up the property for decades (considering the local justice system) in court before the issue is decided, one way or the other.

     

    Question: Why not just have each child sign the DoAS?

    I asked the father to let each child sign on the DoAS. But he said that some of his children are in the provinces and will be very inconvenient for them to come to Manila.

     

    I guess the best solution to ease my misgivings is to have everyone (Father + Children + Spouses of children) to sign on the Deed of absolute sale.

     

    Any more words of advice will be greatly appreciated...

  5. 1. It is legal for so many people to sign the SPA.

    2. You have a legal right to ask for an original copy of the SPA.

    3. You deal with the SPA at your own risk. It is up to you whether or not to accept the SPA.

     

    On another note, even with an SPA, all the names of the children will still appear on the DOS. What will no longer appear are the signatures of the children in the SPA. Again, accepting the SPA is at your own risk and you will have to make your own decision whether to take that risk or not.

    2, Will i have trouble with the Registrar of Deeds if only the name of the father appears in the DOS? the seller requested that only name of father(person given the authority to sell) will appear in the DOS.

    3, Once a transaction is done and a new TCT is issued in the buyer's name. Can it still be undone if one of the children comes out to contest it?

  6. Most Registry of Deeds issue the Certified True Copy of the OCT/TCT/CCT within 3 days. QC and Makati are faster in that it averages 2 days while Caloocan is one of the worse at 6 days. As for getting it faster, of course there are ways, but they are illegal. :rolleyes:

    I'm looking to purchase a house & lot in QC, The TCT bears the name of the father and his 4 children(all of which are married. the mother died and they went thru extra judicial partition process and got a new title.

     

    So instead of drafting a DOS where everyone (father+ 4 children + 4 spouses)signs on the dotted line, the father wants to get a Special Power of Attorney (SPA) from his children authorizing him to sell the property. This SPA will have all the children signed and not separate SPAs for each child.

     

    pls note that i have not met with any of the children, just the father. but the certified true copy from registrar of deeds checked out ok.

     

    So in the DOS, instead of putting all the names of father and children as SELLER. the father alone becomes the seller.

     

    My questions are:

     

    1, Is it legal to have so many people sign a SPA?

    2, Is it ok for me to ask for a copy of the SPA?

    3, Is there a way where i verify the authencity of the SPA?

     

    The thing i want to avoid most is that sometime in the future, one of the children might declared that he did not sign the SPA (his signature is forged) and that he will contest the sale of the property.

     

    How can i avoid problems like this? thanks

    For QC RD, does getting a Certified true copy really takes 1 week? I remember in the 90s. getting a CTC usually takes less than day.

    good looks (Red color)

    build quality and slim form factor (its made mostly of metal)

    Snappy IU

    slide out qwerty keypad (main reason why i bought this fone)

    bright & beautiful screen

    good wifi

     

    Cons

    crappy camera at night ( at least when compared to my e90 )

    expensive ( for now. 22,500)

    lacking D-pad on qwerty keypad.

     

     

    have not tested GPS function yet

I need some technical advice guys, i recently formatted my pc because i assume that i was infected with a virus.. before this my pc use to do a sudden shotdown though the power indicator is still on, it just goes like that without a warning.. i thought i could take care of the virus by formatting my pc.. but the problems seems to be far from being solved.. after installing fresh windows XP (with sp2) i try and tested it, but the problem is still the same.. what you guys think? where does the problem lies? is it on my hardware? but to where? my pc shutdown on a different interval of time,sometimes even longer.. it just shuts down without a warning.. i appreciate anybody who can be of help, TIA! :goatee:

     

    Does your PC go thru ordinary shutdown routine? if so, it can be both hardware (overheating chip/bad memory(hanging)) or software incompatibility ( what have you installed before this happened?) could you be more specific on your installed programs?

  12. I have seen no one mention the HTC Hermes/TyTN. I think it might also be sold as the O2 O2 XDA Trion. Anybody got any experience with this phone? I've been enjoying its predecessor, the HTC Wizard, for a year or so but it is beat all to hell and I'm thinking of upgrading.

    Bought a Hermes200 for my wife. No problem with the software really, But the slider tend to become a little loose after a while. other than that.l it's a great phone.

     

    PS just check out the DEMO dummies in the Dopod kiosks and you'll know what i mean.

  13. Tagaytay is getting to be the best place to go during weekends. Share naman your restaurant experiences. Please include food, service, cost, ambiance, view, etc.

     

    For me, I try to avoid Josephine's because of their bad service. For the low on budget, Mushroom Burger is the place to go. Leslie's is ok. I don't know if Kaye & Ryan is still there but we used to enjoy the food there and the price is really reasonable.

    Rose & Grace is also ok

  14. hey, its great to see this thread going along just fine. ok mga comments nyo guys, keep it up. malaking tulong sa mga nagbabalak bumili ng bagong phones. :cool: right now i'm really undecided whether to ge SE or nokia. nokia boy na kasi ako ever since pero with the way SE phones are coming out these days, medyo nagdadalawang-isip na ko. tuloy lang sa post ha, maybe i'll finally be able to make my decision.

    It really depends on what your needs are. Do you like "tons of apps" and games on your phone? I would suggest you get an S60 nokia. You can read ebooks, play nice games, and even view and EDIT word/excel files on a nokia. ( I have an app on my S60 nokia that changes the profile of the phone-from general to silent and vise versa at certain times of the day(so i won't be disturbed while resting)).

     

    However if you only need (want) basic phone functions plus a great camera/mp3 player etc... I would suggest you get an SE phone.

     

    Forgive me, but coming from an ex-xda2/mini owner. i find the nokia (S60 series) better buys than SE phones.

     

    PS i'm using a N70 now.

    I'm interested in buying a new laptop (Php70-80K), features should be WXGA resolution (1280x800), 12 or 13 ", should not be too heavy, about 2 kg. currently considering MSI 270 coz of the dual-layer DVD-RW and the Turion 64 chip. It gave most bang for the buck. Dell 700m is also nice if it only had a DVD drive. Would not be considering apple coz i just bought an 15.2" Pbook last july (it did not lived up to my expectations). any suggestions? Pls PM me, thanks
