  1. ask ko lang...ano ang Twin notice requirement pra maging legal ang isang dismissal ng employee?

    nag bigay kami ng Notice to Explain, Administrative Hearing, Notice of Termination

  2. Meron kami na Terminate na empleyado.

    Prior to termination, meron kami naserve na NTE. Sa NTE, inamin niya pgkakamali nia. Sa Admin hearing, inamin din nia ulit. Pagdating ng Termination notice, ayaw nia tangapin at he waa questioning about his separation pay. Bumalik pa sya sa ofc 2 times after his last day sa work. During this 2 times, the Termination notice were served again & he refused to signed it. I signed and said subject refused to sign.

    Ngayon may NLRC case kami. Ma technical ba kami dahil di namin napadala un notice of termination thru registered mail.

    Kaso this time cnbi ni gf delayed then at end month, pinakita PT, medyo sketchy un result. After 15 more days, nagpa ultra sound and buntis nga.

    Eh pauwi na bf niang seaman pra pakasalan sya. So sabi nia di nia ako isasabit o ipapaalam ke bf nia kung sino ako at di sya maghahabol. Aakuin daw ni bf ang pgbubuntis nia. Kya nman nia buhayin un bata khit mag isa sya.

    So we parted ways & end our communications.

  4. an employee filed for a leave of absence for 4 days. He reason is to attend to personal matters
    In those 4 days, it was discovered that the employee went to work for another company temporarily but return to its original office on the 5th day to work again.

    What violation did he commit? Is it a grave offense that carries a penalty of termination?

  5. Considering the amount owed to you (PhP40k), a lawyer wouldn't be necessary. As a matter of fact, lawyers are prohibited from appearing in Small Claims proceedings.

     

    Preparation of the complaint for Small Claims is not that difficult since there is a downloadable form in the internet (or you can ask some lawyer friends for it, if you have a few) and you will just be filling up certain information.

     

    The only challenge here is you need to provide pieces of evidence to prove the obligation owed to you (i.e., contract/s, IOUs, Promissory Notes, etc.) which, take note, should all be in the original. No photocopies will be admitted as evidence per the rules on Small Claims.

     

    Alternatively, you can proceed to your city's Hall of Justice and ask for the Small Claims section where they could give you a complaint form to fill up.

     

    Be reminded also that filing a Small Claims would require the payment of filing fees, except those who shall be litigating as indigents (those who are unemployed and has no source of income and those who are below the poverty threshold) or as we call it, "pauper litigants".

    1. You do not need a lawyer. You will just need to fill up a form and submit it.

     

    2. Regular rules on venue applies. You can file it either on the city where you live OR in the city where he lives. Since you are the one filing, the choice is yours.

    do we need a lawyer for this since its a small claims court only?

    where do we file the claim, in the city of our office or in the city where the employee live?

  7. I am an employer, i just fired an employee for AWOL. He still owe us a loan of 40k and he has a promissory note with us using his motorbike as collateral.

     

    What is the process for the confiscation of that bike?

    Our HR has send him a demand letter which he just read & didnt receive nor sign the letter

    Both are unattached and knows my status.

    The first one was obviously a user for her needs which is fine as i get what i want - sex!

    The second is widowed, has 2 kids, self supporting. Madly in love with me and i dono why. She knows her boundaries.

     

    There were some in betweens this 2 as well.

    One wants me to just impregnate her as she only wants a child. No obligations on my end after she gets pregnant. But i declined.

    Some single moms whose only condition is allowance. Many of them around. Their conditions are understandable.

    Then there was a married wife whose husband aint satisfying her sexual needs.

     

    Aint proud about this experiences. Somehow there is something wrong in me as i have a loving wife. She may not be perfect but a lot better than many.

     

    May our Lord give me the strength to get out from these kind of sin and may He forgive me.

  9. ang paggamit ng credit card ng ibang tao ng walang pahintulot ay paglabag sa Section 9(n) ng Republic Act 8484. pwede mo na itong ipa-blotter sa pulis, para maisampa na ang karampatang reklamo sa piskalya (hindi mo siya pwedeng ipa-aresto dahil hindi na siya caught in the act). Magtanong ka na rin sa pulis kung paano mapapabilis ang pagsampa nila ng kaso sa piskalya (bigyan mo na ng pamgmeryenda para maliksi). pagkatapos mo i-reklamo sa pulisya, sumulat ka na rin sa bangko tungkol sa pagsampa mo ng reklamo laban sa taong yun, isama mo sa sulat ang mga ebidensya mo, SABAY HILING NA LINISIN NA NILA ANG PANGALAN AT ACCOUNT MO DAHIL IBANG TAO NGA ANG MAY KAGAGAWAN.

    Thank you ulit po sa pagsagot nio. Nakakuha ako ng 2 charge slip sa 1 merchant. Un 1 may signature at yun 1 wala kc below 2k, no need for signature.Malayo at magkaiba signature namin. Pinakita sakin un cctv pero diko pede i-record. Kitang kita na may gumamit ibang tao. Pano ko po ito i-contest sa bangko na ang sabi nila ay nagamit nga credit card ko kaya dapat ko bayarin kasi hindi ko naireport ng lost or stolen card siya. Sinabi ko sa kanila na ipakita nila mismo sakin ang ebidensya na ako mismo ang gumamit ng card.

    Ang dapat na tanong mo ay: PWEDE KA BA BA NILANG PAGBAYARIN SA CARD NA HINDI MO NAMAN GINAMIT?

     

    Siyempre, hindi!!! Kung hindi mo ginamit, bakit ikaw ang magbabayad. Wala silang karapatang sumingil para sa gastusing di mo naman kagagawan.

     

    Kaya lang, dahil nasa pangalan mo, kailangan mong ayusin yan sa kumpanya (para malinis ang record mo sa credit card companies) para, sa hinaharap, kung ikaw ay mangungutang sa bangko o mag-aapply ng credit card, mabibigyan ka agad. Makipag-ugnayan ka sa credit card company at sabihin/patunayan mo sa kanila na hindi mo nga nagamit kailan man yung card na yan, at ang mga naka-charge dun ay hindi mo kagagawan.

    Thank you po sa advice. Nakausap ko na po ang bangko and its under investigation. At dahil may 1 month na at wala pa silang decision, ako na mismo ang pumunta sa mga merchants at humingi ng mga charge slip at cctv footage.

    Lets say un gumamit ng card ko ay kakilala ko, pede ko ba siya ipaaresto agad dahil may ebidensya nako o dapat mag pa blotter muna ako sa pulis? Anu processo dapat kopo gawin?

    May credit card ako pero never ko ginamit. Its been with me for more than a year and never been used. 1 day, I got a text from the credit card company that there was a fraudulent use on the card so it was declined. Then the statement came with a huge bill which were not mine. Can the credit card company bill me for it?

  12. Pldt sucks! After terminating their service at their office, they will have their customer service call u later to convince u to continue their service. When u say no with finality, you will hear a different tune from their customer service. The poor service of pldt is also reflected by the dumb, stupid attitudes of their customer service. My refund is not refunded and they still continue to charge me. This month if they still bill me, they will have to face dti! assh*le pldt!

    Technically, yes. You can definitely get the IP of where the email came from. You'll only have issues if the sender knows how to hide his/her tracks well. And also, though I'm not sure about cyber laws here in the Philippines, you might need to get a warrant to trace a person via their IP.

     

    does sending thru yahoo and thru google using the same computer gives you the same IP address? How does one gets an IP address? Is the IP address permanent for the same computer irregardless of server?
