depends on the kind of estafa (ang syndicated estafa ay non-bailable eh), although the amount of 350,000 would usually have bail set at 40T.

kung di nyo kayang magbayad ng abugado, me PAO na naka-assign sa korte na yun. kung gusto nyo ng mas maasikaso kayo, may Legal Aid ang Arellano School of Law (sa may Menlo St ito) o di kaya ang UP (sa Diliman).

pwede paba bumaba yong bail? kung ako mag aasikaso bilang kapatid di naman ako ipresure na isama ang utol ko o magiging dis advantage? at kung mapatunayang wala kasalanan si utol what will be the next step o magandang gawin? mababalik ba yong bail na binayad namin? last can we do counter charges at anong kaso kungmeron man?

also, pag nag piyano na si utol ibig ba sabihin may record na sya sa NBI or Police? pwede pa share nadin nang anticipation mo for the procedure / process nang arraignment based on your assesment of what i share here kung possible lang po....para malaman namin din namin procedure para pag nasa trial or pasay city hall na we know kahit kunte mga mangyayari.

Bro, hindi kumpleto ang ma aadvise ko sayo hanggang hindi ko nakikita complete records ng case. Sabi mo nga pinadalhan ng subpoena before ng brother mo, ano ginawa ng brother mo sa subpoena, gumawa ba sya ng counter affidavit? umattend ba sya ng hearing sa prosecutor?

 

As to the bail, naka lagay yan sa information kung magkanong bail ang recommended at nakalagay din yan sa warrant/order na iissue ng court. Kung nakatanggap na kayo ng resolution, may attached na information yan, nakalagay dyan ang amount ng bail.

 

Kung hindi pa nag iissue ng warrant of arrest, pwede pa quash nyo information kung hindi nabigyan ng opportunity ang brothet mo sa saguting ung reklamo sa kanya sa fiscals office or mag move kayo for judicial determination of probable cause. Kung may warrant of arrest na, mag post muna kayo ng bail, either cash or surety. Tapos pwede nyo pa quash ung information kung hindi nabigyan ng oportunidad ang brother mo na sagutin ang accussation sa kanya sa fiscals office. If hindi i grant yun, forced ang brother mo na mag trial. good luck

 

In my opinion, kung tama ang sinabi na naiwan ng taiwanese ung pera sa taxi and un ang statement nya sa complaint nya, at sinabi mo na marami pang sumakay na pasahero sa taxi ng brother mo, sa tingin ko mahina ang kaso ng theft. peace

I wil try to scan the documents and send it to you para mas lalo mo kami matulungan (what is your email add if its ok w/ you).

1) Gumawa nang counter affidavit ( walang katotohanan and puro kasinungalngan binibintang nang complainant na theft ) and brother ko after nya ma receive yong first (1st)na pinadala which is SUBPOENA (naka attached [1]Pasay City Police (SPD) Station Investigation & Detective Mngt Section - A endorsement letter filling a case of THEFT and take not AT-LARGE naka indicate plus, [2] Afidavit from the taiwanese complainant ), pero ang brother ko di naka attend nang hearing dahil busy sa pag papasada nang taxi.

2) Kaya na receive nya yong second (2nd)na pinadala which is RESOLUTION (3pages lang) pero walang amount doon nang bail ang meron lang doon ay amount nang total cost nang laman nang bag which is Php 60,000 for the value of different items like laptop,ps3 and mp3, walang cash na laman as the complainant affidavit.

4) Wala pang warrant of arrest kasama ang resolution na hinatid sa bahay via courier pero as per advised nang napag tanungan namin na PAO sa cityhall yon na daw susunod (warrant of arrest) kaya nag aalala kami. kaya nag tatanong ako dito online kung how much ang maaring bail kahit estimate lang kasi doon sa PAO ang sususngit at laging busy.

Lastly, sabi nang PAO mahina daw ang kaso na THEFT kaya lang since foreigner ang complainant binigyan nang pabor ang taiwanese dahil mainit pa ang nangyari sa Bus Hostage na mga foreigner ang involve at kaya napa bilis din pag asikaso.

kaya salamat sa personal assesment mo PIDO na mahina ang THEFT na case base sa info na share ko.

Papuntahin mo brother mo sa PAO sa pasay. Dapat may PI muna yan bago sinampa sa korte, kailangan pag aralan muna record ng case.

mga attorney's for your assistance please...yong brother ko kasi, driver nang taxi at may hinatid sa airport then may naiwan na gamit o bag sa loob nang taxi eh wala naman napansin yong brother ko at madami na sumunod na sumakay, then the foreign passenger taiwanese together with his Filipina GF / Friend file a complain at pasay rtc, nakatangap na ang brother ko nang complain letter "simple theft" (amounting to Php 60,000 yong value nang laman) ang charges nang yari eto nong june 2010.

always put in your mind that the ADSL technology is a shared connection even via cable connection...normally what telecommunications or ISP's do is an overbooking set up of their subscriber which you always experienced the slow connection and congestion, the reality about this technology even if you get a 2mbps you are not getting the 100% of that speed, normally you only get 25% (your lucky if you get 25%) or less in reality...thats is why they have this kind of marketing strategy: 64kbps up to / burstable to 2Mbps meaning of this you are not guarantee for a 2Mbps you can even go as low as 64Kbps since this is a shared connection...if you really want a quality connection prepare to pay a quality money also...subscribe for a Leased Line, IGATE, Dedicated Internet you called this as SDSL...

Bottomline...be contented in ADSL because thats what fits on our budget, if you are just using it in the house for browsing, emailing and simple application purposes...

look for analog x in google and install it, you can use also the ping plotter for you to determine the pocket loss, haps and latency that you are getting.
