    Bro, follow-up question...... can I pass the CGT to the buyer? Am I not violating BIR rules on CGT, beside there's written agreement between the buyer and the seller.

  3. The first thing you should do is have the deed annotated (adverse claim) with the registry of deeds or the city/municipal assessor so that third parties can be notified of such deed of sale. Second, send a demand letter to the seller. If he still refuse to give you the title (TCT) you have no other recourse but to file a case against the seller for specific performance, asking him to fulfill his obligation in the deed of sale plus damages.

    Clarification pls on annotating the deed of sale; is this a must for a Deed of Sale?

    Regarding the TCT, am afraid or I doubt if the TCT is availalbe; I think the lot is due for registration, that's why I hold paying the whole price. What's my recourse on this case?

  4. Another case, amigos!

    I had acquired a parcel lot in Mindanao last year (August 2007). Received the Deed of Sale with notarial; paid 83% of agreed price; will pay the balance upon receipt of the title. But to this date, I have not received the title. I doubt the seller could return my money if I decided to cancel the deed of sale (is cancellation possible?). Do you have remedy or recommended action items I could take to push the seller to give me the TCT? or is this (titling) my responsibility?

  5. I had acquired a townhouse unit on year 2000 and fully paid on year 2006; I have already cleared paying the real property tax with our municipal up to this year 2008. According to NHMFC, there is a 12,000 VAT I need to pay; is this the CGT?

  6. Article 41 of the Family Code

     

     

    There are four (4) requisites for the declaration of presumptive death under Article 41 of the Family Code:

     

    1. That the absent spouse has been missing for four consecutive years, or two consecutive years if the disappearance occurred where there is danger of death under the circumstances laid down in Article 391, Civil Code;

     

    2. That the present spouse wishes to remarry;

     

    3. That the present spouse has a well-founded belief that the absentee is dead; and

     

    4. That the present spouse files a summary proceeding for the declaration of presumptive death of the absentee.

Your problem would be, by the time that you will pay the aforementioned taxes, the BIR will already charge you with interest, surcharges and penalty (in addition to the 7.5% you have to pay) kasi overdue na yung taxes. deadline in paying for the capital gains tax is at least 1 month from the date of the sale, while for the doc stamps, 5th day of the following month. kaya habang pinapatagal mo pagbabayad, mas lumalaki taxes not unless both of you would execute a new deed of sale.

     

    Bro, your advise needed:

    My younger brother bought a townhouse unit on Oct 2000; but was not able to pay the CGT thereafter; my understanding is that the seller should shoulder paying the CGT, but nothing mentioned on their deed of sale; he wont get new deed of sale coz the seller already migrated to Canada after completing the deed of sale; can my brother sell the property and execute new deed of sale so he can skip the remaining unpaid period? is this transaction VATable?
