Hi, any advise po for Nuisance case? We are living near a alcohol maker company about 3 meters away, they are causing bad smell, noise, dust and yung moist ng cooling tower and we are very prone to fire since sobrang lapit namen kung San iniimbak yung finish product.  local government is not doing anything about it since alam naman naten why( under the table might be happening.) Any advise po??

    A few questions and comments:

    1. Are they operating in a zone classified as a residential area? Because that in itself may be cause to have them close or relocate their business, depending on whether or not your city or municipality has ordinances limiting property use in residential zones.

    2. By "alcohol" do you mean liquor? Or industrial/disinfectant alcohol? Either way it would be good to check if they have the requisite permits and regulatory clearances (sanitation, fire, BIR, etc.) The lack of any of those is enough to have it shut down via a complaint before the agency or city department issuing said clearance or permit.

    3. With the noise, dust, and smell, the establishment my be considered a "public nuisance" under Article 695 of the Civil Code. If you opt to go this route, you will need to file an action for abatement of nuisance with the local courts.

The problem will be, if you live in a zone that is primarily an industrial zone, then it is unlikely that you will be able to get the manufacturer shut down, simply because based on the land use zone, you're not supposed to be living there. In this scenario, the solution to your problem is for you to relocate elsewhere.

    Hope these help.

what if adopted name (surname ng stepdad ginamit) ang ginamit sa kasal pero siya hindi legally adopted? is it voidable?

no. short answer is, correction of pertinent records lang yan, none of the elements of a voidable marriage are present (ie. duress, underage, etc.)

hindi rin siya "fraud" kasi the surname of a person has nothing to do with vitiating consent. puwera na lang if the stepfather's surname was used to commit a larger fraud (ie. she claimed na anak siya ni X at may makukuha siyang inheritance, kaya na-entice si lalaki na magpakasal sila, etc)

History may repeats itself.

Ikuwento mo yan sa mga taong nilusob ang Malacanang habang umeeskapo si Marcos. Tignan mo kung di ka pagtawanan.

A 5% lead in the surveys leading to election day isn't exactly commanding. You can label a 30%-40% lead, depending on which current survey you're looking at as commanding. Yes, we all saw what happened. Massive cheating and this is evidenced by the ongoing electoral protest.

    "Ongoing"

Um, tapos na yung electoral protest. Talo si Boingboing.

A complaint of cheating is not itself evidence of cheating. That's not how complaints work. Convictions that have achieved finality, however, is sufficient basis to say that a person is a criminal.

  6. funny how people are saying there is no divorce in this country. meron tayo - under the Muslim Code of Personal Laws, and under the laws recognizing IP traditions where they have practices akin to divorce.

the only reason we don't have civil divorce is opposition from conservative Christian fundamentalists who prefer to keep people in broken marriages, because "mah beleyfs and mah relighun." kahit wala naman tayong state religion, and supposedly secular ang batas, and kahit wala namang kinalaman sa sarili nilang kasal.

here's irony for you: few Christian churches recognize civil marriages, if at all. kelangan daw "kasal sa simbahan" or sa minister or whatever. pero they oppose civil divorce, which would strictly speaking dissolve only the marriages as registered in the Civil Registry, and would not affect their own church records. as if wala silang sariling mechanism for dissolving marriages within their churches. for sure yung simbahang Katoliko meron, they even got part of it into our Family Code as Article 36.

  7. Even Publicius data (which is inherently ??? due to their use of "purposive sampling") shows a decrease of around 5% preference for Marcos and an equivalent increase for Robredo. All other candidates are have statistically negligible movement. It's a question of sustainability.

"Only covert intervention by foreign superpower(s) can derail the popular mandate." Uh, sure, if you say so.

" And you think BBM/Du30 camps don't know how to counter that?" Bold of you to assume that they are in fact on the same page. Then again your comment was made before Duterte and Go withdrew their respective candidacies. I'm sure you'll find a way to spin it and make it something positive for Marcos and Inday, so please go right on ahead.

Umm deny what? Apologies but I can only speak for myself.

im not privy to where you are getting your numbers. In my experience survey numbers can always be skewed. I’ve done some little research and came across a summary of surveys done by Manila Bulletin. In some of those polls BBM came out the leader while in other cases it was either Leni or Isko. What’s probably impressive is the fact that in the other poll surveys that BBM did not lead he was always a close second. I didn’t see any 82% figure if I may say.

So there you have it. There’s no denying here but actual poll figures printed by Manila Bulletin. You can check their website if you want to verify. A simple rejoinder, surveys doesn’t make a President. From now till the last ballot is counted a lot of things CAN, MAY and DO change. Let’s see who will sit in the fabled palace of Malacanan by then.

For now congratulations to BBM for being elected as the next Philippines president via poll surveys.😊😊😊

Recent history has shown that the front runner throughout October-February/March isn't always the winner nga naman. Villar and Poe come to mind. Some people are *ahem* too excited about survey results.
