Yes they can terminate the contract but the question if they will get the security deposit will depend on what was stipulated on your contract

After 10-day period from the issuance of CFA, the counting of the prescriptive period of two (2) years from the time of the alleged violation will resume.

CFA as in Certificate to File Action? Di naman to needed sa DTI cases.

I hope someone answers this:

We have a mango tree near our house and pag nagbubunga siya, may mga bata na umaakyat though palagi namin sila pinagsasabihan na sungkitin na lang kaysa akyatin since baka malaglag sila and the branches are infested by really big ants.

my question is if umakyat sila without our knowledge and nalaglag yung bata (nagka injury or worse, namatay) can we be held liable for this kahit pinagsabihan na namin sila? kasi may mga bata na matitigas talaga ulo, sawayin mo tapos they climb the tree an hour later or pag wala kami sa bahay...

I hope any lawyer can answer this if liable kami na paospital yung bata or pampa libing if namatay..

AFAIK, no liabilities as long as walang utos/request/order na galing sa inyo na umakyat kahit sino dun, if anything, they can be held liable for tresspassing/damage to property if yung tree is sa loob ng property line ninyo.  

I admire your concern for the safety of the kids, best thing to do IMO is to contact the homeowners association / barangay so that the kids' parents will be informed dun sa ginagawa ng mga anak nila.   You can only do so much after that.  Let's hope na wala namang maaksidente dahil sa kakulitan lang. :)

yes sir, actually naka tayu yung puno ng mangga sa property namin mismo.

sige sir if ever will contact the barangay, and di naman namin pinagdadamot yung mangga kasi di naman namin kailangan yung madami, but at least now I know na wala kaming liability sa ganun.

HIndi po ba yan mag fall dun sa attractive nuisance doctrine.  meaning, a landowner may be held liable for injuries to trespassing children if the injury is caused by an object that is likely to attract children?  Thanks po.

paano sir if di sila nagpaalam or wala kami sa bahay, will we still be held liable knowing na wala kami sa time na yun....

wala pa naman nag complain sa amin but I am making sure di ito maging problem namin in the end.

yes bro,matagal yung process but also, pwede mo naman siya paayus kung saan ka nakatira, but you have to shell out at least 250K pero mga 3-4 yrs ago pa ito, di ko alam ngayun magkano singilan...

si Kris Aquino paid P500K to have her marriage to JAmes Yap annulled sa QC courts, this was a long time ago na so mas mahal na now but if you decide to go ahead mga 200K or more kasi may appearance fee mga abogado mo kada hearing and may mga papeles na babayaran tapos babayaran mo pa yung courier ng extra para kumilos.

Meron kami na Terminate na empleyado.

Prior to termination, meron kami naserve na NTE. Sa NTE, inamin niya pgkakamali nia. Sa Admin hearing, inamin din nia ulit. Pagdating ng Termination notice, ayaw nia tangapin at he waa questioning about his separation pay. Bumalik pa sya sa ofc 2 times after his last day sa work. During this 2 times, the Termination notice were served again & he refused to signed it. I signed and said subject refused to sign.

Ngayon may NLRC case kami. Ma technical ba kami dahil di namin napadala un notice of termination thru registered mail.

nag bigay kami ng Notice to Explain, Administrative Hearing, Notice of Termination

Compliant na kayo sa twin notice rule. Pag kinasuhan kayo ng employee sa DOLE, show the efforts done by the company in complying with the requirements under the Labor Code.

Ikaw yung nag serve ng notice of termination? Server usually just executes affidavit of service stating intended recipient refused to accept and explaining the circumstances of the attempted service. DOLE hearings are less formal but also pro-laborer. Just show the company tried to comply with the requirements of the Labor Code.

I just wanna ask this one:

Let us say mga sir/ma'am you have a GF that is 23 years of age, assuming maglayas siya sa kanila (or magtanan na kami )to be with you, given that she is of right age, pwede pa din ba ako kasuhan ng magulang ng kidnapping if siya ang pumunta sa amin? will I be held liable criminally??

Ang may personality lang to file the criminal complaint ay yung GF mo. Hindi makakapagfile yung parents niya. At most, pwede lang silang magreport sa police.

Whether or not magiging criminally liable ka, nakadepende sa GF mo kung biglang sabihin niya na dineprive mo nga siya ng liberty niya, etc.

Best way to protect yourself right now is to gather evidence na voluntarily siyang sumama sayo.. Take selfies na enjoy kayo. Hehe.

yes sir, thank you so much pero siya nga talaga gusto sumama sa akin kaso yung nanay niya ang strict....wala na siyang tatay iniwan sila when she was a child, she has an older sister.

I was scared kasi baka ma file ako ng kidnapping ng magulang since sumama naman yung anak niya sa akin, hehehe

i think hindi yan kidnapping. well in the first place may consensus naman nung girl. and for your peace of mind. here's what kidnapping is....

 kidnaping, criminal offense consisting of the unlawful taking and carrying away of a person by force or fraud or the unlawful seizure and detention of a person against his will

(according to google)
