Divorce In The Philippines

Not really, napakamahal ng process and takes years. Also kelangan pang majustify ang annulment which is mahirap ang requirements.

Divorce is much better and should be affordable and easier to all.

Why would you want an easy way out of marriage?

 

The family is the foundation of our society. Strong family bonds are needed to build a strong nation. This is the principle kung bakit mahirap ang requirements to justify annulment -- para mag-isip-isp muna bago maghiwalay. Ang paghihiwalay ng mag-asawa ay hindi dapat gawing madali. Kaya nga hindi dapat basta-basta nag-papakasal in the first place. At kung may problema ang pagsasama bilang mag-asawa, pagtiyagaan na ayusin muna dahil napakahirap magpa-annul.

Yes for me. Annulment and the others are not really options because 1) they take years and 2) really expensive. Tapos ang underlying basis pa ng mga yan is that one of the parties is "psychologically incapacitated". It means you have to point out that 1 of you is at fault. It doesn't capture the reality that sometimes 2 people really are not meant for each other, or that they were at the start but have gorwn apart. Sometimes you are not really the same person you were in your 20's, and who is the government in preventing the both of you from doing the mature thing and agreeably parting ways?

 

In fact, ang nangyayari ngayon mas magulo pa. Either they stay together but within a loveless or even turbulent marriage where neither is happy, or they just live apart but can't really start the next chapter of their lives because they are legally and financially tied together. Sa akin lang naman, but I think it's the Church's way of telling us that we can't be trusted to make our own decision. Why prevent something and limit the options when you really trust your flock to do the right and "Catholic" way?

Among the hundreds of my friends and families who are married, there are a handful who are in irreconcilably turbulent relationship. A small minority. That tells you that the vast majority of people in our country take marriage seriously and they make their marriages work.

 

The government is not preventing people with failed marriages from doing the mature thing and agreeably part ways. They can do that anytime. They can part ways. But they can't marry again while his/her spouse is still alive. There are few things in this country that you're allowed to do only once, and one of those is getting married.

annulment is saying null and void ung marriage, so its as if you were never legally married. fraud, biological incapacity etc. some grounds like certain abuses arent covered by annulment.

Far behind morally? On the contrary, we are the few remaining country who take marriage seriously and who still believe in the principle of keeping a strong bond within the basic unit of society -- the family -- to achieve a strong and cohesive nation.

Divorce is a long overdue law that should been passed ages ago, we are not a backward country anymore and shouldn’t have a backward thinking anymore, Divorce is not for all but needed by a lot.

If your against it, then your mind is closed and stupid!

There is no such thing as a perfect relationship, but there is also a worst relationship. Something that is not expected in the long road to happen.

I’m a male OFW, yes I am seeing someone now, Yes I never ever missed one opportunity to give almost everything for my lone son(tuitions,daily, even their bills).Yes we are (hopefully) now in good terms with my previous partner as we are both adults now with open mind thinking. We only still care whats good for our child, but our relationship will never be the same ever. We wanted to get out on this shackles, but will never left out the child that bonded us. We both crave for divorce to set us both free.

funny how people are saying there is no divorce in this country. meron tayo - under the Muslim Code of Personal Laws, and under the laws recognizing IP traditions where they have practices akin to divorce.

the only reason we don't have civil divorce is opposition from conservative Christian fundamentalists who prefer to keep people in broken marriages, because "mah beleyfs and mah relighun." kahit wala naman tayong state religion, and supposedly secular ang batas, and kahit wala namang kinalaman sa sarili nilang kasal.

here's irony for you: few Christian churches recognize civil marriages, if at all. kelangan daw "kasal sa simbahan" or sa minister or whatever. pero they oppose civil divorce, which would strictly speaking dissolve only the marriages as registered in the Civil Registry, and would not affect their own church records. as if wala silang sariling mechanism for dissolving marriages within their churches. for sure yung simbahang Katoliko meron, they even got part of it into our Family Code as Article 36.

Can you even give details why annulment is better?  Ang daming pumapayag na  mentally incapacitated yung lalaki para lang may legal basis yung annulment kahit hindi naman totoo.  So ang lumalabas kailangan mo pang magsinungaling para lang ma approve kahit both parties agree to live their separate ways.

1divorce, in the most base explanation if you're talking to a 12 year old, means "you WERE married, legally" while annulment means "you were NEVER married; whatever you had back then was never valid". 

with the previous statement, annulment also NULLIFIES the family code thus all "conjugal" properties will no longer be recognized as conjugal. automatically. 

--- legal separation and divorce DO NOT recognize this. not automatically. a separate process needs to be done regarding the separation of properties. 

 

(am pro divorce btw. just pointing out the most damning difference between divorce and annulment).

In the Philippines, people are starting to look at murder as the way out of a bad marriage. 

Why?  Because of out sick marriage laws.  

I also notice a lot of young people looking at marriage laws in other countries, and not anymore getting married under Philippine laws.
