Firearms Regulations

Just came from the gun show at SM Megamall yesterday to do some research on what pistol I should get. I already have a licensed 1911 with a PTC, but I want something smaller for more convenient carrying.

 

I've been trying to find the Philippine laws and PNP regulations on the internet about gun ownership and carrying, but the PNP website is horrible. All I found on Google is Executive Order 194, MC 2010-008, and MC 2011-005. A couple of questions:

 

1.) I see that the conditions for the Permit to Carry states that:

"For All Other Persons. (including members of the PNP AFP and other LEAs in civilian attire)

a) Display of firearm is prohibited (The firearm must always be concealed)

B) The firearm must be secured inside a vehicle or a motor cycle compartment.

 

Does this mean that the firearm should ALWAYS be concealed and should always be in the vehicle? Medyo useless kasi PTC kung sa kotse mo lang pwede gamitin. Or does this mean that when it is in the vehicle, it should be secured inside some sort of compartment?

 

2.) I read somewhere (a news article) that gun ownership is limited to one handgun and one long firearm. Is this true? I already have a .45 pistol, but I want to get a smaller .40 or 9mm. Pwede pa ba?

 

THANKS TO ANYONE WHO CAN CLARIFY. Although I hate these regulations that are aimed at responsible people (instead of criminals), I want to follow them anyway.

for #1: some people can carry firearms using a discreet ankle or leg holster, or using a shoulder holster and wearing clothing over these. if it is inside a motor vehicle, it should be concealed within a compartment. if you'll notice a lot of small-time, petulant belligerents among the police ranks generally like to brandish their guns. heck, when i was still in school, our barbarian of a security guard likes to pump his shotgun in front of students. all the while when they shouldn't be exempted from this rule.

 

for #2: NUMBER AND TYPES OF FIREARMS THAT MAY BE POSSESSED

  • Each individual may hold under license a maximum of only one (1) low-powered rifle caliber 22 or shotgun not heavier than 12 gauge and one (1) pistol or revolver, not higher than caliber .38 except caliber .357 and caliber .22 center fire magnum and those which may later be classified by the Chief, Philippine National Police (C, PNP) as high-powered regardless of the type, make or caliber.
  • Officers and non-commissioned police officers enlisted personnel in the active service and in the retired list of the Philippine National Police (PNP) and Armed Forces of the Philippines (AFP) may hold under license a maximum of only one (1) low powered rifle caliber .22 or shotgun not heavier than 12 gauge and one (1) sidearm of any type or caliber.
  • Commissioned Officers in good standing of the Reserve Force of the AFP who are on inactive status may hold under license a maximum of only one (1) low-powered rifle caliber .22 or shotgun not heavier than 12 gauge and one (1) sidearm not heavier than caliber .45, except caliber .357 and caliber .22 center fire magnum and those which may later be classified by the C, PNP as high-powered regardless of the type, make and caliber.

Damn, that sucks. That means I can't even buy a small .40 or 9mm if I already have a 1911? Family heirloom na din kasi yung 1911, gusto ko sa bahay lang siya.

You can have as many firearms as you'd like as long as they are not "crew serviced" weapons. Erap signed an EO when he was president repealing the law about "one long, one short" firearms only. I myself have 4 pistols of various calibers. All legally possessed and know others with multiple handguns and high powered rifles(5.56mm, 7.62mm) all legal.

no smart-ass, the regulations are not vague. there is no limit to the number of firearms you can own according to the Erap Bill as long as they are duly licensed! furthermore, a crew-served weapon is a weapon that needs more than two people to operate, i.e. a machine gun, a bazooka, a recoiless rifle, a howitzer........

I really don't see the logic in putting a limit on the number of firearms an individual pay possess legally. If ever, this law will only encourage individuals who have reached the limit allowed to acquire and possess the guns illegally.

 

It doesn't make any sense at all.

 

resurrecting an old thread. first and foremost, the NEW Firearms Law is to take effect this coming July/August, and there is an on-going amnesty at the moment. the new law actually gives you a License to Own a Firearm, not a Firearms Licene per se. this means you need not get a license every time you get a firearm. there are also different categories in the license (like a driver's license), and depending on which category you apply to, there is a limit to the number of firearms you could get. the lowest, category 1, allows you to get 2 firearms (note, no more one long and one short), all the way to category 6, with 15 firearms. the new law also limits all firearms to SEMI-AUTO only. in other words, you could get an AK, but only the semi-auto version.

being enforced....pero ide declare ba lahat ng firearms that u possess?
