Guyz..need some help and advice...a good friend of mine (girl) is having a problem so just need help....yung friend kong girl with his partner..kumuha ng Rent to own houze and lot....ok sana ..kaso nagkaroon sila ng problem...naghiwalay sila...now ang concern nung girl is dun sa kinuha nilang hauz..sabi sa akin nag-invest si girl ng 20k dun sa hauz kaso nakapangalan sa guy yung hauz kasi lahat ng document na requirement is mayroon si guy at ala si girl...ngayon since naghiwalay sila...may possible way ba na mapasakanya yung hauz at sya nalang magpapatuloy ng bayad..isa pa concern kahit sa resibo ng bayad sa guy parin nakapangalan ...si guy kasi contribution niya is yung documents pero yung bayad/financier is si girl...pinaliwanag ni girl sa opis na sya ang financier at yung guy lang is for document....ok naman daw yon basta pumayag si guy ipagamit mga requirements nya..after 1yrs daw pde na i transfer ang title sa girl pag ok na...kaya ginawa nung girl is pinachange address nalang niya yung kung saan didiliver yung mga sulat regarding sa hauz..para pag maysulat eh mamonitor niya kung matratansfer na yung title...

 

worried lang...what if di pumayag si guy ipagamit yung document?? may habol pa ba si girl na mapatransfer yung title sa kanya ?

is there any other way ? di kasi ineexpect ni girl na maghihiwalay sila...kaya kala niya for the future nila...kaso eto,,medyo paranoid...so concern lang to seek advice..thanks in advance

AFAIK.

from the payee's perspective the money is coming from the guy. 

 

unless... you have a paper trail that proves that the money is coming from the girl. example: cheques cleared.

if this was done via cash.. you re in for a pain

 

i hope they separated in good terms.. and ask the guy to sign an agreement.

 

to me all youve said is verbal and you might just be making it up. I dont know the girl or the guy, i will base my decisions over whats on paper.

 thanks for this information...honestly yun din kutob ko..how would she prove na sya tlaga...all documents is on the guy's name...kaso she's insisting na sya nag finance, so I askd her bakit sa name ng guy...coz lahat ng document such as pag-ibig mayroon yung guy....sya wla...so agreement nlng nila na sa name ng guy ..di nya ineexpect na magkakalabuan sila...wla na balak guy regarding sa hauz.. ..

 

now the update is ..nakausap na nya yung agencies and told na coconvince nalang yung guy to continue the hauz hangang sa maturn over..then hanap ng ibang buyer para marefund yung equity na naibigay nila...madali lang daw makahanap ng buyer since the hauz is already approved ng pagibig...yun sabi... hope this would work..as long the guy would accept to continue...and agreement nalang nila is pumayag yung girl na hati sila sa makukuha refund...its a total of 25k kasi yung equity and down..and pumayag naman yung agencies/developer as long pumayag yung guy... any more tips and idea would really appreciate it...tnx

Hi I need help, 

 

may pinsan ako nakabili ng property, na check naman at pareho doon sa previous owner ang technical description sa title. Ayun pala, yung previous owner hindi napansin na may typo error dun sa title nya. Ang problem is yung isang coordinate instead of South, naging North.. Kaya pag plot ng technical description hindi nagclose ang drawing ng property. Paano ipapaayos ito? Madali lang ba ito? Ano ang mga requirements for this? Magkano aabutin ang ganito? Thank you in advance sa makakatulong.

It's a good thing it's not fully paid. That means the title is still in developers name and hasn't been transferred yet. There is still hope. Just talk to the developer. 20k is a small amount, so I'm guessing that's just a small percentage of the total.

kung lola mo nman xa sir e absolute deed of sale na lang kht installment ang bayad. basta payag ang lola mo at trusted ka nman nya na babayaran mo xa ng buo.

Get a Geodetic Engineer to plot the survey points of the property in question and then submit it to the Register of Deeds for correction of an error.

mga sirs/ma'ams,   any ideas po magkano magagastos sa  kapag hinati na sa mga heirs yun original title?   patay na kasi yun original owner and  3 yun anak nya and isa na lang yun nabubuhay pero hindi pa naisasalin sa mga anak nya yun property.  gusto na kunin ng mga apo ng original owner  yun shares nila before pa mamatay yun surviving na anak ng original owner (their auntie) salamat po sa mga mag rereply.

mga sirs/ma'ams,   any ideas po magkano magagastos sa  kapag hinati na sa mga heirs yun original title?   patay na kasi yun original owner and  3 yun anak nya and isa na lang yun nabubuhay pero hindi pa naisasalin sa mga anak nya yun property.  gusto na kunin ng mga apo ng original owner  yun shares nila before pa mamatay yun surviving na anak ng original owner (their auntie) salamat po sa mga mag rereply. 

 

Yung sa father-in-law ko, they went through a judicial settlement kasi walang last will and testament.  Find a lawyer, one that specialize or has experience in estate laws.  Cost will depend on the lawyer/law firm you engage.

Question nakabenta ako ng condo worth 2M magkano dapat naging commission ko verbal usap namin nung unang may contact sa seller na dapat hati kami sa 5 percent comission nung kaya tiwala ako ng nagkabentahan binigyan lang ako ng 10k kasi yun lang daw binigay ng tyuhin nya na broker di ba balasubas yung naging kausap ko ano dapat kong gawin may mabebenta na naman ako na worth 2.2M sabi ko sa unang kausap ayaw ko ng verbal dahil dinaya nila ako oo naman ang sagot nya mukhang magkakabentahan ulit at sabi nya hati daw kami sa 5 percent at wala na tyuhin nya

hello po, need advice po.

got this case na nagissue na ng decision ung RTC but di nagawan ng writ of execution or finality. naglapse na ung 5 years.but there is a decision also from Court of Appeals na the decision of the RTC still stands, kasi may nagappeal ata inakyat nila sa Court of Appeals. tapos un, naipasok na rin sa Entry of Judgement.

questions are:

1) kelangan pa ba gawan ng Revival of Judgement?

2) sabi ng RTC di na daw kelangan gawan ng finality or writ kasi self-executory na ung decision, the case is about who owns the property kasi. nakalagay lang sa decision sino ung rightful owner.

3) sabi din sa RTC na mas mataas ung Court of Appeals so ung finality un na din ung sa Court of Appeals.

4) ung decision kasi sa vendors' name pa. itransfer na kasi namin sa name namin. kelangan muna ba ilakad ito bago ilipat? kasi nakapending ung transfer for 4 years over na.

please help.

inherited real estate
heir is husband
property will be exclusive of husband. correct?
but tct will have name of husband married to wife. is this for description only?
assuming wife dies, will it affect the inherited property? meaning there will be a extra judicial settlement? if so how can it be when its exlusive property of husband?

may notice po na magkakaroon po ng VAT ang real estate tax. puwede ba yun? i tax ang tax?

 

ang rason ng BIR, local tax daw ang real estate tax kaya puwedeng patungan ng buwis.

heir is husband
property will be exclusive of husband. correct?
but tct will have name of husband married to wife. is this for description only?
assuming wife dies, will it affect the inherited property? meaning there will be a extra judicial settlement? if so how can it be when its exlusive property of husband?

If husband is the only heir (no kids), and there is no will, then it will become exclusive property of husband upon wife's death.

Never do verbal only. There's no proof. It's your word against his.

Gastos mo is capital gains tax 6%, brokers commission if any, and vat 12% if the property was leased out.

Good day! First time ko bibili ng lot sa province. The owner is in canada and the seller is his son with POA issued from canada. What are documents should I check and require from seller. What are the payments that I need to shoulder for the title processing being the buyer. What are the payments due for the seller. Thanks.

Mga boss ask KO lang.. Meron kase nagbebenta ng lupa..kasama na yun bahay na nakatayo.. Worth 250k dto sa talaba cavite.. Bale rights lang yung lupa kaya mura..my question is anu yung pwede Kong panhawakan na katunayan na sa akin na yung bahay at lupa since wala naman titulo yun. How safe ba bumili ng ganitong property..ask KO lang po sa mga eksperto..salamat

Guys, is it OK to buy a lot with only Tax Declaration as proof of ownership by the Seller.  The land is located in the province and has no title yet.  I've ask the Notary Public if there will be problem in buying the lot even without title and told me that there's no problem and in fact more easier to process than those with titled lands.

Seller pays capital gains. All other expenses are for buyer.
Get the followings docs: title, tax dec for land, tax dec for improvement if any, location plan, poa authenticated by embassy, at least 2 valid government id's of owner and son (passport and 1 other), bir tin, and proof that real estate taxes are paid up.
